AN ACT to amend a chapter of the laws of 2018, relating to authorizing and directing the commissioner of education to conduct a study on the effects of trauma on child development and learning as proposed in legislative bills numbers S.8000-B and A.10063-B, in relation to authorizing and directing the commissioner of children and family services to conduct a study on the effects of trauma on child development and learning; and to repeal certain provisions of the education law relating thereto
The People of the State of New York, represented in Senate and Assembly, do enact as follows:
Section 1. Subdivision 59 of section 305 of the education law, as added by a chapter of the laws of 2018, amending the education law relating to authorizing and directing the commissioner of education to conduct a study on the effects of trauma on child development and learning, as proposed in legislative bills numbers S.8000-B and A.10063-B, is REPEALED.
§ 2. A chapter of the laws of 2018, amending the education law relating to authorizing and directing the commissioner of education to conduct a study on the effects of trauma on child development and learning, as proposed in legislative bills numbers S.8000-B and A.10063-B, is amended by adding a new section 1-a to read as follows:
§ 1-a. The commissioner of children and family services, in consultation with the commissioner of education and the commissioner of health, is authorized and directed to conduct a study on the effects of trauma on child development and learning. Such study shall include, but not be limited to, the following:
(i) the types of trauma experienced by students;
(ii) the impacts of trauma on child development and learning;
(iii) screening and assessments of trauma available in schools;

(iv) programs, interventions, and services related to trauma that are available in schools; and
(v) best practices for school personnel in the area of trauma as it relates to child development and learning.
b. On or before December 31, 2020, the commissioner of children and family services shall deliver a report of the findings of such study and recommendations based on such findings to the governor, the temporary president of the senate, the speaker of the assembly, the minority leader of the senate and the minority leader of the assembly. Such report shall also include such legislative proposals as the commissioner of children and family services deems necessary to implement his or her recommendations.
§ 3. This act shall take effect on the same date and in the same manner as a chapter of the laws of 2018, amending the education law relating to authorizing and directing the commissioner of education to conduct a study on the effects of trauma on child development and learning, as proposed in legislative bills numbers S.8000-B and A.10063-B, takes effect.
