What's happening

This bill makes permanent the law allowing Boards of Cooperative Educational Services to provide services to out-of-state school districts.

Why it matters

  1. Expanding Educational Collaboration. By making the law permanent, New York’s Boards of Cooperative Educational Services (BOCES) can continue to share specialized programs and resources with out-of-state school districts, fostering greater regional educational cooperation and efficiency.

  2. Sustaining Revenue Streams. The ability to serve out-of-state districts can provide BOCES with additional revenue, potentially reducing costs for New York taxpayers and helping maintain or enhance educational offerings within the state.

  3. Promoting Program Stability. Permanently authorizing these services ensures that schools, both in New York and neighboring states, can reliably plan for cross-border educational initiatives without future disruptions or uncertainty about the law’s expiration.

  4. Supporting Educational Equity. Out-of-state districts, especially those lacking certain specialized programs, will have ongoing access to BOCES expertise and services, which can help address disparities and improve educational opportunities for students in bordering regions.

Title of bill

An act to amend chapter 396 of the laws of 2012, amending the education law relating to services to out-of-state school districts by boards of cooperative educational services, in relation to making the provisions thereof permanent

Purpose

This legislation makes permanent the ability of Boards of Cooperative Educational Services (BOCES) to sell programs and services to out-of- state school districts.

Summary of specific provisions

Section one of the bill removes the repeal date to make permanent the provisions established pursuant to Chapter 396 of the laws of 2012.

Section two establishes the effective date.

Justification

BOCES are innovators in the development and delivery of highly success- ful curricula. By removing the sunset date that authorizes BOCES to enter into contracts with out-of-state school districts, we are provid- ing BOCES the opportunity to continue to generate additional revenue, which ultimately benefits their component school districts and the students they serve.
