What's happening

This bill requires, rather than authorizes, New York's Department of Health to make additional Medicaid payments to certain public hospitals for inpatient services.

Why it matters

  1. Makes supplemental Medicaid payments to qualifying public hospitals mandatory rather than optional. , which could improve financial stability for hospitals serving large numbers of low-income and uninsured patients.

  2. Ensures eligible public hospitals are fully compensated for their Medicaid and uninsured patient losses. (up to 100%), potentially reducing service cutbacks or closures in vulnerable communities.

  3. May impact New York State’s Medicaid budget and fiscal planning. , as the Department of Health must now guarantee these payments rather than exercise discretion, potentially increasing state expenditures.

  4. Could strengthen the healthcare safety net in counties with eligible public hospitals (excluding New York City). , supporting continued access to inpatient care for underserved populations.

Title of bill

An act to amend chapter 474 of the laws of 1996, amending the education law and other laws relating to rates for residential healthcare facili- ties, in relation to directing the department of health to make addi- tional payments for inpatient services to certain public general hospi- tals

Purpose

To preserve and continue New York State's payment of the SUNY hospital's state match as required by the federal government to ensure future eligibility for DSH funding.

Summary of provisions

Section 1 amends part D of Chapter 59 of the Laws of 2016 to require New York State to pay the state match for SUNY hospitals operated by SUNY and the State.

Section 2 of the bill establishes the effective date.

Justification

In order to receive federal DSH money for serving high numbers of Medi- caid and uninsured patients, institutions are required to make a state match. New York State has historically paid the DSH state match for public hospitals, including the three SUNY hospitals. This bill is necessary to ensure that New York State continues to meet its financial obligations to the SUNY hospitals by continuing to provide the state match, enabling them to receive critical DSH funding.

In the absence of a state match SUNY hospitals would be ineligible to receive up to $300 million in DSH funding. Institutions serving high- needs communities, such as SUNY Downstate, would be adversely impacted.
