What's happening

This bill allows state-owned lands in the towns of Blooming Grove and Chester, Orange County, to be subject to real property taxation.

Why it matters

  1. Increases local tax revenue. By allowing state-owned lands in Blooming Grove and Chester to be taxed, the towns and their school districts could see a significant boost in property tax income, which can help fund public services and infrastructure.

  2. Shifts financial burden. Currently, these lands are exempt from property taxes, meaning other local property owners pay a larger share of the tax base. Taxing state lands could lower the tax burden on private residents and businesses in these towns.

  3. Establishes local precedent. Including Blooming Grove and Chester aligns them with other towns in Orange County where state lands are already taxable, potentially influencing future decisions regarding state land taxation elsewhere in New York.

  4. Impacts state and local relations. The bill may affect the balance of fiscal responsibility between state and local governments, as the state would need to allocate funds to cover property tax payments, potentially impacting state budgeting and priorities.

Title of bill

An act to amend the real property tax law, in relation to subjecting certain state lands in Orange county to real property taxation

Purpose or general idea of bill

To subject all lands in the towns of Chester and Blooming Grove acquired for a public use by the commissioners of the Palisades Interstate park to local real property taxation.

Summary of provisions

Section 1: Amends section 532 of the Real Property Tax Law, to subject all land in the towns of Chester and Blooming Grove acquired for a public use by the commissioners of the Palisades Interstate park to local real property taxation, in the same manner as is currently done in the towns of Monroe, Warwick, Cornwall, Highlands, Tuxedo, and Woodbury in Orange County, and in the towns of Gardiner, Rochester, Shawangunk and Warwasing in Ulster County.

Section 2: Effective date.

Justification

Similar state lands within the Palisades Interstate Park are fully taxa- ble. State-owned tracts in the towns of Chester and Blooming Grove should be treated similarly to those in the towns of Monroe, Warwick, Cornwall, Tuxedo, and Woodbury, Orange County.
