What's happening

Empowers residents to advocate for their healthcare needs. by making it explicit if they can retain the services of their own doctor, which can be crucial for continuity of care and trust in medical decisions.
Creates greater accountability for nursing home facilities. by mandating a formal statement of policy in residency agreements, reducing the risk of confusion or disputes over medical care arrangements after admission.

Title of bill
An act to amend the public health law, in relation to prior notice of physician privileges in nursing home residency agree- ments
Purpose or general idea of bill
Requires nursing homes to provide potential residents with their policy on granting physician privileges prior to the execution of a residency agreement.
Summary of specific provisions
Adds a new paragraph q to subdivision 3 of section 2803-c of the public health law.
Justification
Potential nursing home residents have a right to know which physicians will be available to provide care prior to signing a residency agree- ment. Many individuals enter nursing homes having pre-existing relation- ships with doctors in their community. Whether or not those physicians already have or have the opportunity to be granted privileges may play an important role in choosing a nursing facility.
