What's happening

This bill authorizes Tarrytown to transfer certain parkland for zoning purposes, provided replacement land is dedicated as parkland.

Why it matters

  1. Facilitates Land Use Flexibility. By allowing Tarrytown to "alienate" (i.e., remove parkland status from) a small, irregular parcel, the bill enables the village to address zoning issues that may hinder development or property adjustments, potentially making land use more efficient or compatible with community needs.

  2. Parkland Replacement Safeguards. The act mandates that any parkland taken out of public use must be replaced with new land dedicated as parkland, ensuring that the overall amount of public green space is preserved and that residents do not lose recreational opportunities.

  3. Fair Market Value Protection. If the replacement parkland is not of equal or greater value than the land being removed from park status, the village is required to provide additional land or invest in park improvements, protecting public investment in green spaces.

  4. Federal Funding Compliance. The bill includes provisions to ensure that if federal funds were used for the original parkland, all necessary federal requirements are met before any changes are made, safeguarding against potential loss of funding and ensuring compliance with federal law.

Title of bill

An act authorizing the alienation of certain parklands in the village of Tarrytown, in the town of Greenburgh, in the county of Westchester

Purpose or general idea

To authorize the Village of Tarrytown to discontinue the use of certain land presently dedicated for parkland to complete a transfer of land previously agreed to by the Village and to make an undersized and irreg- ularly shaped parcel more zoning compliant.

Summary of provisions

Section 1 of the bill authorizes the village of Tarrytown to discontinue as parklands and alienate certain lands for completing a transfer of land previously agreed to by the village and to make an undersized and irregularly shaped parcel more zoning compliant.

Section 2 provides that the authorization provided in section one of the act will only be effective on the condition that the village of Tarry- town dedicate the lands described in section 4 as parkland; provided that the village has never used such lands for public open space purposes.

Section 3 provides a legal description of the parklands to be discontin- ued.

Section 4 describes the replacement land to be acquired and dedicated by the village of Tarrytown as parkland.

Section 5 provides that in the event the land acquired and dedicated as parkland is not equal to or greater than the fair market value of the parklands to be alienated, the village of Tarrytown shall acquire and dedicate additional land for parkland and/or cause funds to be made available for capital improvements to its existing park and recreational facilities, as necessary, to equal such difference in fair market value.

Section 6 provides that if the village of Tarrytown received any funding support or assistance from the federal government for the purchase, maintenance or improvement of the parklands to be alienated, the discon- tinuance and alienation of the parkland shall not occur until the village of Tarrytown has complied with any federal requirements pertain- ing to the lands including compliance with any conditions imposed by the secretary of the interior.

Section 7 is the effective date.

Justification

In 2011 the Village of Tarrytown purchased 11.38 acres of land that was part of a subdivision that created both open space parcels and parcels to be developed. As part of the subdivision planning the Village Plan- ning Board agreed to sell a small parcel of land (approximately 3,301 sq. ft.) to a neighboring property owner in order make their property more zoning compliant. During the course of the review process which

took several years, this agreed to transfer of land was inadvertently overlooked.

This legislation will authorize the Village of Tarrytown to discontinue the use of a small piece of parkland to complete a transfer previously agreed to while ensuring that the Village receives parkland or capital improvements to current parkland and recreational facilities of equal or greater value.
