What's happening

This bill allows retired public employees to authorize automatic deduction of membership dues for the Retired Public Employees Association, Inc. from their retirement allowance.

Why it matters

  1. Expands retiree choice and convenience. Allows retired public employees to easily support the Retired Public Employees Association, Inc. (RPEA) through automatic dues deduction, eliminating the need to make manual payments, which may be especially helpful for older or less tech-savvy retirees.

  2. Strengthens retiree advocacy organizations. By making it easier for retirees to maintain membership in the RPEA, the bill could increase the organization’s resources and influence, potentially resulting in stronger advocacy for retiree issues such as pension protection, health benefits, and legislative priorities.

  3. Ensures ongoing, revocable consent. The bill specifies that deductions will continue until the retiree submits written revocation, ensuring retirees have control and flexibility over their membership and finances, while also reducing administrative complexity for both retirees and the association.

AN ACT to amend the retirement and social security law, in relation to deductions for retiree organization dues

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. Section 110-c of the retirement and social security law, as amended by chapter 165 of the laws of 1993, is amended to read as follows:

§ 110-c. Deductions from benefits of certain retired members. 1. Notwithstanding any other provision of law, a retired member shall have the right, at any time after the retiree's retirement, to execute and file a deduction authorization card with the comptroller authorizing the deduction from the retired member's retirement allowance of membership dues and such retired member's share of the cost for employee organization-sponsored benefit plans and the payment thereof to a retiree organization of which the retired member is then a member and which is then affiliated with either an employee organization certified or recognized as the collective bargaining representative of all employees in the negotiating unit of which the retired member was a part prior to his or her retirement or with an employee organization with which such employee organization is then affiliated. The comptroller shall thereafter deduct from the retirement allowance of such retired member the amount of membership dues and such amounts required to be paid by such retired member for such authorized employee organization-sponsored benefit plans, and shall transmit the sum so deducted to said retiree organization. Such authorization shall continue in effect until revoked in writing by such retired member. Title of bill

An act to amend the retirement and social security law, in relation to deductions for retiree organization dues

Purpose or general idea of bill

To amend the Retirement and Social Security Law to allow retirees to elect to have their membership dues to a not-for-profit organization representing New York State governmental employees deducted from their retirement allowance.

Summary of provisions

Section one of the bill amends Retirement and Social Security Law section 110-c by adding a new subdivision 2, which allows retirees who are members of the Retired Public Employees Association, Inc. to elect to have their membership dues deducted from their retirement allowance. The election is filed with the Comptroller and remains valid until revoked.

Section two of the bill provides that this act shall take effect imme- diately.

Existing law

Currently, retirees may elect to have the dues costs associated with such retiree's membership in an employee organization that is certified or organized under the Taylor Law and the costs associated with such retiree's participation in a benefit plan sponsored by such employee organization.

Justification

This bill would eliminate the need for retirees who are members of the Retired Public Employees Association, Inc. to mail a check for their dues each month. Currently, retirees who are members of an employee organization that is certified pursuant to the Taylor Law are afforded the ability to have their dues and any costs associated with benefits from such organization deducted from their retirement allowance.
