AN ACT to amend the agriculture and markets law, in relation to the reuse of tires
The People of the State of New York, represented in Senate and Assembly, do enact as follows:
Section 1. Section 16 of the agriculture and markets law is amended by adding a new subdivision 50 to read as follows:
50. The commissioner, in consultation with the commissioner of environmental conservation, shall promulgate rules and regulations allowing the reuse of tires in agricultural production including, but not limited to, for the protection of animal feeds in a manner that protects farmers, workers and animal health and addresses the vector threat posed by such tires using techniques appropriate for protection of human health and the environment to prevent the site from being a vector breeding area.
§ 2. This act shall take effect on the one hundred twentieth day after it shall have become a law. Effective immediately, the addition, amendment and/or repeal of any rule or regulation necessary for the implementation of this act on its effective date are authorized to be made and completed on or before such effective date.

Purpose or general idea of bill
This bill will allow for the Commissioner of Agriculture, along with the Commissioner of Environmental Conservation, to promulgate rules and regulations for the reuse of tires in agricultural production.
Summary of provisions
Section 1: Amends Section 16 of Agriculture and Markets law by creating a new Subdivision 50. Section 2: Provides for the effective date.
Justification
Tires are often utilized on farms to secure tarpaulins that may cover corn silage or haylage, protecting feed stocks from harsh weather. However, these tires may become breeding grounds for vectors such as mosquitos, prompting the Department of Environmental. Conservation to enact regulations requiring farmers to halve or drill utilized tires on their farm. Unfortunately, if farmers were forced to drill or halve the tires, they could potentially break the metal wire in the tires, which could contaminate their feed, and pose significant health risks to cows or other livestock.
This legislation will help New York farmers address these new regu- lations by allowing for the Commissioner of Agriculture, along with the Commissioner of Environmental Conservation to adopt rules and regu- lations to address agricultural use of tires on farms and further aid New York State farms in this matter.
