What's happening

This bill amends New York penal law to create a single, uniform license to both carry and possess a pistol or revolver, removing distinctions based on employment, location, or reason.

Why it matters

  1. Standardizes handgun licensing. By creating a single, uniform license to both possess and carry a pistol or revolver, the bill eliminates previous distinctions based on occupation, location (such as home or business), or specific need. This reduces confusion and administrative complexity for license holders and authorities.

  2. Widens eligibility for concealed carry. The removal of requirements to show “proper cause” or to be in specific professions means more people could qualify for a concealed carry license, potentially increasing the number of legally armed civilians.

  3. Statewide consistency, local exceptions. The new unified license is valid across New York State, but still requires a special permit to be valid in New York City, preserving some local control despite overall standardization.

  4. Impact on enforcement and public safety. By simplifying and unifying the licensing process, the bill could change how law enforcement tracks, manages, and verifies pistol and revolver licenses, while potentially shifting the balance between gun rights and public safety concerns.

Title of bill

An act to amend the penal law, in relation to licenses to carry and possess firearms

Purpose or general idea of bill

This legislation allows for the holder of a pistol license to carry the weapon concealed.

Summary of specific provisions

Section 1 of the bill removes language that limits the individuals who are eligible to carry a pistol concealed. The section clarifies that an individual who has a license for a pistol or revolver shall be issued a license to carry concealed and possess without regard to employment or place of possession.

Sections 2-8 removes the word or and replaces it with and to show that it is both for a license to carry and possess.

Section 9 is the effective date.

Justification

This legislation seeks to affirm an individual's Second Amendment right to carry their licensed weapon on them at all times. Currently in New York there are significant limitations to allowing an individual to carry a weapon concealed. By allowing licensed individuals to carry a concealed weapon we are making public places safer at a time where random acts of violence are occurring. It is no coincidence that these acts of violence occur often at places where an active shooter has no worry that an individual may be carrying a concealed weapon and in turn may be able to stop them.
