JACOBS -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the public health law, in relation to the New York Right to ID Act The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. This act shall be known and may be cited as the "New York 2 Right to ID Act". 3 § 2. Subdivision 3 of section 4173 of the public health law, as 4 amended by chapter 293 of the laws of 2019, is amended to read as 5 follows: 6 3. (a) The registrar shall be entitled to a fee of ten dollars for 7 each certification of birth or death or for each certified copy or 8 certified transcript of any record of a birth or of a death or for a 9 certification that a search discloses no record of a birth or of a 10 death, furnished by him to an applicant, except that no fee shall be 11 charged for a search, certification of birth or death or certified copy 12 or certified transcript of a birth or a death record to be used for 13 school entrance, employment certificate or for purposes of public relief 14 or government compensation or when required by the veterans adminis- 15 tration to be used in determining the eligibility of any person to 16 participate in the benefits made available by the veterans adminis- 17 tration, provided that no fee shall be charged for a search, certif- 18 ication of birth or certified copy or certified transcript of a birth 19 record where the applicant is requesting a search of which he or she is 20 the subject or is requesting his or her certification of birth or a 21 certified copy or a certified transcript of a birth record where the 22 applicant is a Medicaid eligible person and the applicant has not previ- 23 ously made such a request to the registrar, provided further, however, 24 that if such registrar is a city clerk, town clerk or village clerk, he 25 shall collect such fees for and on behalf of the city, town or village EXPLANATION--Matter in italics (underscored) is new; matter in brackets [ ] is old law to be omitted. S. 6912 2 1 in which he serves, provided, however, that an amount equivalent to the 2 sum of such fees shall be paid at least monthly by such city, town or 3 village to such city clerk, town clerk or village clerk entitled to 4 receive fees as a registrar of vital statistics. 5 (b) Notwithstanding paragraph (a) of this subdivision, in the follow- 6 ing county jurisdictions the fee shall be set by the county health 7 commissioner: Chemung, Monroe, Onondaga, Tompkins; and in the following 8 local jurisdictions the fee shall be set by the local legislative body: 9 city of Oswego, city of Albany. In such jurisdictions, the fee may be 10 set up to the amount charged by the commissioner as prescribed in subdi- 11 vision two of section forty-one hundred seventy-four of this title. 12 § 3. This act shall take effect immediately.
