What's happening

This bill allows water authorities to make purchases and contracts through U.S. and state agency contracts, similar to other local entities.

Why it matters

  1. Expands purchasing options for water authorities. , allowing them to use contracts negotiated by federal, state, and other local governments, which could result in lower costs and more efficient procurement for water infrastructure and services.

  2. Levels the playing field with other local entities. by giving water authorities access to the same bulk purchasing and competitive contract opportunities already available to other political subdivisions, potentially improving service delivery.

  3. Retains accountability and equity requirements. , maintaining obligations for water authorities to comply with minority- and women-owned business enterprise (MWBE) program mandates and preferred source purchasing rules, ensuring continued support for these priorities even with expanded procurement flexibility.

Title of bill

An act to amend the general municipal law, in relation to including water authorities to make certain purchases and to contract for certain services through the use of U.S. and state agency and political subdivi- sions

Purpose

This bill would authorize water authorities to make certain purchases and to contract for certain services through the use of U.S. and state agency and political subdivisions.

Summary of provisions

Section 1. subdivision 16 of section 103 of the general municipal law by adding "water authority," which would allow water authorities to share contracts with municipalities and water districts.

Section 2. is the enacting clause.

Justification

During 2012, a new subdivision 16 was added to the General Municipal Law section 103 to authorize political subdivisions and districts therein to purchase apparatus, materials, equipment and supplies - and to contract for services relation to the installation, maintenance or repair of those items - through the use of contracts let by the United States or any agency thereof, any state of any other political subdivision or district therein. Unfortunately, this law excluded water authorities from sharing contracts with municipalities and water districts. This would correct that by allowing water authorities to participate in this cost saving measure to help keep costs down for their customers.

Fiscal implications

None to the state.

Local fiscal implications

None.

Effective date

This act shall take effect immediately; provided, however that the amendments to subdivision 16 of section 103 of the general municipal law made by section one of this act shall not affect the repeal of such subdivision and shall be deemed repealed herewith.
