AN ACT to amend the criminal procedure law, in relation to designating uniformed court officers in the town of Busti, county of Chautauqua, as peace officers
The People of the State of New York, represented in Senate and Assembly, do enact as follows:
Section 1. Section 2.10 of the criminal procedure law is amended by adding a new subdivision 85 to read as follows:
85. Employees of the town of Busti, in the county of Chautauqua, serving as uniformed court officers in the justice court of such town; provided, however, that nothing in this subdivision shall be deemed to authorize such employees to carry, possess, repair or dispose of a firearm unless the appropriate license therefor has been issued pursuant to section 400.00 of the penal law.
§ 2. This act shall take effect immediately.

Section 2. Provides that the act shall take effect immediately.
Justification
The town of Busti, by unanimous vote, adopted a formal resolution in support of legislation that would designate its uniformed court officers as peace officers. A peace officer designation will both allow a uniformed court officer to maintain his or her peace officer status and certification for future employment, and decrease liability for the town of Busti by filling the position from a pool of peace officer certified candidates.
