What's happening
This bill allows the building inspector for the Town of Pendleton, Niagara County, to live outside the town but within Niagara or an adjoining county.
Why it matters
Expands the pool of qualified candidates. for the Pendleton building inspector position by allowing applicants from a broader geographic area, potentially leading to more experienced or specialized hires.
Addresses local recruitment challenges. the Town of Pendleton may be facing, such as difficulty finding qualified inspectors willing to reside within the town’s boundaries.
Maintains local control for other towns. by specifying that this exception applies only to Pendleton; all other towns must still hire building inspectors who live within their own borders unless future legislation provides otherwise.

Title of bill
An act to amend the town law and the public officers law, in relation to authorizing the building inspector in the town of Pendleton, county of Niagara, to reside outside such town
Purpose or general idea of bill
To allow the building inspector for the town of Pendleton to reside outside the Town.
Summary of specific provisions
Section 1 Adds a new subdivision 35 to section 23 of the town law to allow the building inspector for the town of Pendleton to reside outside the Town.
Section 2 adds a new subdivision 71 to section 3 of the public officers to allow the building inspector for the town of Pendleton to reside outside the Town.
Justification
This legislation, which is at the request of the town, would allow them the opportunity to hire a building inspector who is not a resident. The town is in desperate need of hiring a qualified building inspector, and the town reports an extreme shortage of viable candidates who reside inside the town. This legislation will ensure public safety by allowing a qualified building inspector to be hired, regardless of location.
