FERNANDEZ -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the executive law and the mental hygiene law, in relation to establishing a state director of drug policy The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The executive law is amended by adding a new section 4-c to 2 read as follows: 3 § 4-c. Director of drug control policy. The governor shall appoint a 4 director of drug control policy for the state and receive a salary to be 5 fixed by the governor within the amount appropriated therefor. The 6 director of drug policy's responsibilities shall include the following: 7 1. lead the state drug control effort, including coordinating with the 8 state agencies that impact drug policy and associated funding; 9 2. coordinate and oversee the implementation of state drug policy; 10 3. assess the adequacy of the state drug control programs and the 11 budgets for those programs; 12 4. evaluate the effectiveness of state drug control policy efforts; 13 5. identify and respond to emerging drug threats related to illicit 14 drug use; 15 6. facilitate broad-scale information sharing and data standardization 16 among state and local entities to support the state drug control 17 efforts; 18 7. assist the governor in the establishment of policies, goals, objec- 19 tives, and priorities for drug policy; 20 8. consult with and assist local governments with respect to the 21 formulation and implementation of drug control policy; and 22 9. serve as an ex-officio member of the opioid settlement board estab- 23 lished pursuant to section 25.18 of the mental hygiene law. Subparagraph (ii) of paragraph 3 of subdivision (c) of section 2 25.18 of the mental hygiene law, as amended by chapter 171 of the laws 3 of 2022, is amended to read as follows: 4 (ii) two appointments by the governor, one of which shall be the 5 director of drug control policy appointed pursuant to section four-c of 6 the executive law; 7 § 3. This act shall take effect on the ninetieth day after it shall 8 have become a law.
