10 of God in East Meadow, New York, will deliver
11 today's invocation.
12 Pastor.
13 PASTOR HUNTE: Thank you very much.
14 It's a pleasure for me to be a part
15 of signing bills (chuckling). And I pray to God
16 to help us.
17 There's a scripture that I have in
18 mind in Luke 18:1 that says men must always pray
19 and not faint. God wants us to pray to Him
20 before we do anything in life, He's so longing
21 for the prayer of people.
22 I thought about great King Solomon.
23 When he was called to govern Israel, God realized
24 and he realized that he was very small for the
25 job. And then one night God spoke to him and

1 asked him, "What would you want me to do for
2 you?" He did not ask for money and riches, but
3 he asked God for wisdom and knowledge to lead his
4 people.
5 I think it was in the Book of Second
6 Chronicles, He said, if My people who are calling
7 My name humble themselves and pray and seek My
8 face and turn from their wicked ways and draw
9 close to God, God would heal the land. He'd open
10 heaven and heal the land.
11 And we want to look to God in
12 prayer. And especially for the Senators that
13 gather here, we realize that decision making, it
14 is not always easy. So we leave our mind to God.
15 Some things are bigger for us to handle, but God
16 is bigger than everything. And that's Who we
17 want to look to this evening.
18 Our Father, we want to thank You.
19 Indeed, it's a privilege that we're able to come
20 before You. You say in Your word that men must
21 always pray and not faint. God, we look to You
22 on behalf of the Senators that are gathering
23 here, my God, looking for understanding and
24 wisdom, knowledge to lead and to make decisions
25 that will affect our country.

1 Lord, our country is sick and needs
2 healing. And we are praying that You will bless
3 these Senators, that You could use them for the
4 healing of the land, Father. Bless them in a
5 special way that when they sign bills and put
6 laws in operation that, Lord, they will look to
7 You, Father, for help and the wisdom and
8 knowledge that they were able to serve the people
9 and make people's life more comfortable.
10 We thank You for these men that take
11 on this job in the Senate and Congress, and great
12 responsibility. And, Lord, they're responsible
13 to You -- not just to the people, but responsible
14 to You.
15 So, Father, we're looking to You
16 that You will help, that You will use them in a
17 mighty way and bless this session, my God. And
18 that You will be the silent listener, Father, to
19 what will be discussed here. And, Lord, Your
20 name alone will be glorified.
21 Help the Senate, help each
22 individual here. Help them make decisions, Lord,
23 knowing that God is looking on. And Lord, our
24 desire is to please You. We know without You we
25 are nothing. Our country needs help. And we

1 pray that You will bless these Senators here and
2 use them for the healing of the nation.
3 Glorify Yourself, Lord, and that
4 Your name alone be praised and that You will get
5 the honor out of this session. Thank You again,
6 Lord. Have Your way and bless these men. And,
7 Lord, we will continue to praise You and we will
8 continue to keep praying to You, Father, because
9 only You have the answer for mankind, to have
10 Your way.

14 I'm sure the men and women of this
15 chamber appreciate the blessings we received
16 earlier.
17 Let's begin by calling up
18 Senator Breslin for an introduction.

21 SENATOR BRESLIN: Thank you,
22 Madam Chairman.
23 As most of you know, I've been in
24 this chamber a long time rooting for my local
25 high school basketball teams. And I've watched

1 Mount Vernon and Boys High years ago, and now
2 Bay Shore on Long Island. But we had the answer
3 this year. That answer is Green Tech.
4 And I'd love everybody from
5 Green Tech to stand up so you can be -- right
6 now, before I talk about you.
7 And, you know, Green Tech, their
8 coach, Coach Jones, he had the right approach.
9 He said, We're going to take on all comers. We
10 want to play the best to be the best. And so
11 what did they do? They started off this season
12 9 and 6 -- 9 and 6, not so good. They ended up
13 20 and 6. They played the best.
14 And it came down to -- there's a new
15 division in basketball in the state, there's a
16 AAA as opposed to AA. These guys are AAA. And I
17 took -- I took to -- I called a couple of my
18 friends who referee your games at times, and they
19 all had great things to say about you,
20 Coach Jones, your floor assistants, and in
21 particular all the boys that you have coached to
22 this victory.
23 And the victory came against
24 Bay Shore, who came in 25 and 0 -- 25 and 0. And
25 then I looked at some of the statistics. They

1 were beyond even Senator Bailey's numbers from
2 long ago.
3 (Laughter.)
4 SENATOR BRESLIN: And he would of
5 course come back and say "Even beyond yours,
6 Senator Breslin."
7 SENATOR BAILEY: Right.
8 SENATOR BRESLIN: And so when I
9 looked at 10 three-pointers in the first half,
10 that's great. It's not so many for the Celtics,
11 but it's a lot in high school.
12 And your whole team, from the
13 number-one player to the last player on the
14 team -- and I don't know who that is, and I don't
15 care. You are a team, and there's no "I" in
16 team. And in the final game up in Glens Falls --
17 they're usually very close games, very close
18 games -- you guys kind of put on your warm-up
19 jackets midway through the fourth quarter when
20 you were ahead I believe 74-50.
21 Well, you have blessed us. In
22 Albany, New York, you are the state champions.
23 And I salute each and every one of you for coming
24 to our New York State Senate. And I am so proud.
25 I look forward to having you invite me to games

1 next year, and maybe some summer league games
2 this summer, which I'm sure will be going on,
3 there'll be some travel squads.
4 But you all have a right to be very
5 proud of your accomplishments. And to your coach
6 and the assistant coaches and all the team, thank
7 you and congratulations.

3 SENATOR WEIK: Thank you,
4 Madam President.
5 Wrestling, although a team sport, is
6 very much an individual feat of personal strength
7 and discipline. Having been married to a
8 wrestler for almost 30 years, I know firsthand
9 wrestlers are a different breed of athlete.
10 Cutting weight, nutrition and strength training
11 are just the starting points. The psychological
12 training is the most important skill a wrestler
13 acquires. The sacrifices and self-discipline
14 shape the strategy and help to overcome the sheer
15 difficulty of the sport.
16 Wrestling is the kind of sport that
17 never leaves an athlete. The life experiences
18 learned in the wrestling room during practice are
19 like nothing else; they stay with the athlete.
20 He or she has learned to stick with that task to
21 the end, no matter what. Almost nothing in life
22 will be more challenging than the physical and
23 mental lessons mastered on the mat.
24 That's why it gives me great
25 pleasure today to welcome the Plainedge

1 High School Varsity Wrestling Team. The caliber
2 of excellence each wrestler possesses in order to
3 advance their way to the top makes each one the
4 best in class. Together as a team, they are the
5 New York State Division I champions.
6 Individually, they will always be legendary
7 athletes.
8 Senator Steve Rhoads and I would
9 like to introduce the Plainedge Red Devils. And
10 as a Senator whose name is constantly messed up,
11 I apologize sincerely; these are some difficult
12 names.

3 Devin Downes won the 170-pound individual state
4 championship and was also recognized as the
5 Champion of Champions when he won that state
6 championship, the first one in 12 years.
7 The dual-meet state championship was
8 the first in this school's history, and the first
9 on Long Island to win the state dual championship
10 since 2019.
11 And so to this team, you bring us
12 great pride, and we congratulate you. Thank you
13 so much.

11 this chamber, led by Anthony Nicodemo, their
12 teacher, and a number of other teachers, as well
13 as Anthony is the athletic director of the
14 school.
15 Please welcome them as they tour
16 around the Capitol today, learn about what we
17 do, and experience firsthand democracy as it
18 works in action.

20 You know, the Reverend Dr. Martin
21 Luther King had a neighbor by the name of
22 Dorothy Lee Bolden. She was a domestic worker in
23 Atlanta, Georgia, and had been once since the
24 tender age of just nine years old.
25 With the encouragement of her

1 neighbor, Dorothy began to organize nannies,
2 housekeepers, and elder-care providers to make
3 demands for respect and dignity from their
4 employers. Domestic workers, like farmworkers,
5 are some of the original excluded workers; these
6 sectors are explicitly carved out of the
7 National Labor Relations Act and the Fair Labor
8 Standards Act.
9 This workforce, made up
10 predominantly of Black and immigrant women, makes
11 the rest of our economy possible by providing the
12 care work needed to allow the rest of us to go to
13 work.
14 Well, in 1968, Mrs. Bolden founded
15 the National Domestic Worker's Union of America,
16 which eventually represented more than 30,000
17 domestic workers in 10 cities and was the longest
18 surviving union of domestic workers throughout
19 the United States.
20 Organizing domestic workers is a
21 very unique challenge. Their employers' homes
22 are the workplace, where a union organizer cannot
23 reach them and where they are isolated from the
24 company of coworkers with whom to organize. But
25 like any good union organizer, Dorothy knew you

1 have to meet people where they are, sometimes
2 literally. She would ride the bus for hours,
3 sitting next to domestic workers, striking up
4 conversations and registering them to vote.
5 Public transit was the union hall.
6 Dorothy, who led the union for
7 28 years, continued to fight for domestic workers
8 right until she died in July of 2005. Because of
9 her advocacy, the National Domestic Workers
10 Alliance was born just two years later, in 2007.
11 In 2010, New York became the first
12 state to win a Domestic Workers' Bill of Rights.
13 And this body has passed my bill to grant
14 domestic workers across the state the security of
15 paid sick leave.
16 Every year members of the
17 National Domestic Workers Alliance and We Dream
18 in Black celebrate Mrs. Bolden's birthday and the
19 legacy she left for all domestic workers.
20 The members of the National Domestic
21 Workers Alliance-New York Chapter stand in the
22 strong and proud tradition of Mrs. Bolden's work,
23 and we will continue to fight for this paid sick
24 leave to become law here in New York State
25 together.

3 the fight against the last vestiges of Jim Crow.

8 Today I'm joined not just by one
9 winning team, but two winning teams from
10 Hoosic Valley.
11 Odyssey of the Mind is an
12 international educational program in which
13 students from kindergarten through college learn
14 how to think divergently by working as a team to
15 solve open-ended problems. Students learn
16 creativity, innovation, problem-solving, critical
17 thinking, global awareness, interpersonal and
18 collaborative communication skills,
19 self-direction and adaptability.
20 Hoosic Valley competed against over
21 250 teams across New York State, and they came
22 home with two first-place teams -- one at the
23 high school and one at the middle school.
24 Joining us today from the
25 high school are Isabella Schmidt, Evan Antolick,

2 Marie Ackerley, Amelia Stannard, and
3 Sophia Wilson.

20 Last week Syracuse lost a true
21 champion for civil rights -- and a legal
22 trailblazer -- with the death of Judge Langston
23 McKinney.
24 He was trained as a chemist at
25 Howard University, then joined the Army and went

1 on to get a law degree at Syracuse University in
2 the late 1960s, where he founded the Law Students
3 Civil Rights Research Council and helped develop
4 the first course on poverty law.
5 After graduation, he practiced as a
6 Legal Aid lawyer, and in 1986 he was appointed
7 the first Black city court judge in Syracuse. He
8 was subsequently reelected three times and served
9 ultimately for 24 years on the court.
10 He was known for fairness and
11 kindness, for his attention to tenants and people
12 living in poverty just as much to those with more
13 power and resources.
14 He developed the Syracuse Community
15 Treatment Court for defendants with substance
16 abuse issues, and he advocated for more minority
17 representation on juries.
18 When you met Judge McKinney, in
19 spite of his unassuming good nature, you felt you
20 were in the presence of greatness. We honor him
21 now in death, but it is heartening to know that
22 he was honored in life as well. Since 1989, his
23 name has graced a major public housing
24 development in the center of the city, a fitting
25 tribute for a man who developed a Tenants' Bill

1 of Rights that became a model for housing
2 projects all around the country.
3 I ask my colleagues to join me in
4 mourning the death and celebrating the life of
5 Judge McKinney, a remarkable public servant. Our
6 condolences go out to his window, Linda
7 Littlejohn, and their children and grandchildren.

6 reputation of the Buffalo Bills fans. We love
7 our Sabres. But there's another team in Buffalo
8 that we rarely hear about, and that is the
9 Buffalo Bandits Lacrosse Team. It's not the most
10 well-known sport across North America, but boy,
11 are the fans super excited about what happened
12 this year in Buffalo.
13 So the Buffalo Bandits won the
14 National Lacrosse League Championship. It was a
15 back-to-back victory. They were dominant through
16 the season, and they won all five of their
17 playoff games, including a sweep of the final two
18 rounds. And they beat the Albany FireWolves and
19 were very happy to take that title back to
20 Buffalo.
21 It's a national league throughout
22 North America, and there was an amazing
23 19,070 people in Buffalo to watch the
24 championship game. And I'm proud to report that
25 I was one of those screaming fans.

2 indoor lacrosse, I recommend you go out and see a
3 game. The league is in Buffalo, Rochester, or
4 Albany. And as a Senator from Buffalo, I don't
5 get a lot of chances to talk about sports

17 colleague Senator Walczyk, who as we all know is
18 most definitely out of the country -- but
19 Sackets Harbor on St. Patrick's Day, 68-66, at
20 the Glens Falls Civic Center, home of a lot of
21 great state championship games.
22 That weekend was no exception. It
23 was great to have two local teams, North Warren
24 and the other team that was there we recognized
25 last week, Glens Falls.

1 For the boys, when I had to chance
2 to visit with them earlier today, the other thing
3 I didn't mention is how exciting it was to see
4 that Civic Center packed. So many people there
5 from the community cheering on home teams like
6 yourselves. Four losses during the whole
7 season -- to bigger schools, for sure. They have
8 one young man on the team that's an 8th-grader.
9 And, you know, Glens Falls won't be hosting the
10 basketball championships for the next three
11 years, but certainly I'm going to do everything I
12 can to make sure that by the time that kid
13 graduates, that he'll be playing in front of a
14 hometown crowd again for another state
15 championship.
16 But boys, congratulations. The
17 community was so thrilled and excited for you.
18 What a fantastic weekend of basketball. I was
19 glad to be there with you guys and see the hard
20 work and watch you guys these past couple of
21 years on this run that you've been on.
22 And Madam President, if I could,
23 just to recognize Coach Jim Cuyler and Assistant

15 they managed to get back to Glens Falls and bring
16 home the championship trophy.

19 also join me in congratulating them, and extend
20 to them the cordialities of the house.

17 There seems to be a trend in --
18 regarding people that are incarcerated and their
19 children, where video visits are replacing actual
20 face-to-face visits with families.
21 All of the data that we've
22 researched indicates that when kids have the
23 right, the ability, to go visit an incarcerated
24 parent, it helps not only the person that's
25 incarcerated but the children, it helps them

1 better the children in their lives.
2 What we're seeing is a trend where
3 private equity firms work with companies like GTL
4 and Securus that provide, at predatory pricing,
5 video conferencing with children and the person
6 that's incarcerated. And the private equity
7 firms like this because it's recession-proof.
8 I encourage everyone to read an
9 article that came out recently in the American
10 Chronicles of the New Yorker that talked about
11 that children have a right to hug their parents.
12 I can tell you that it's a crying shame, that if
13 this is a trend that this state is going to go
14 towards, that we should stop it immediately.
15 Children who have incarcerated
16 parents, family members who have incarcerated
17 family members, the priority should be that they
18 have face-to-face visits with those that are
19 incarcerated.
20 Look at the information that we
21 have. It's much better for all involved. It's
22 much better for society, because those that are
23 incarcerated have a recidivism rate that's even
24 lower when they have this standing relationship
25 with their families.

1 So I encourage my colleagues to vote
2 in the affirmative. This is a lot more critical
3 than you may think for what meets the eye. I
4 encourage my colleagues to look at the
5 information, look at the research, so they can
6 see that if we go on this trend, we're going
7 backwards and we're creating a worse situation,
8 especially for children who have incarcerated
9 parents.

17 Unfortunately, New York State
18 prisons have become much more violent places in
19 recent years, largely due to bad policy out of
20 this chamber and the chamber next door, with
21 things like HALT and other things. We have
22 really been --have not done the job we're
23 supposed to do of protecting the employees of the
24 state government, making our prisons a safer
25 place for them and, by the way, for those that

1 are incarcerated there.
2 So this bill is a step in the wrong
3 direction. We've heard from many that passing
4 contraband, including weapons, often happens with
5 these direct contacts. While we do not wish to
6 deny parents the ability to embrace their
7 children, there's a simple solution to that:
8 Don't go to prison in the first place. Be a good
9 parent. That's the solution.
10 I'll be voting no. Thank you.

15 You know, not everyone was meant to
16 go to college. That's not the path for everyone.
17 And the idea that we're going to promote a
18 different form of college, an education in the
19 trades, is one that I think is a wonderful idea.
20 As the son of a union carpenter and
21 someone who was raised with the benefits of
22 having a parent who was able to work in the
23 trades, earn a living wage and a great wage, able
24 to support his family, the idea that we're going
25 to promote the trades coming to high schools and

1 giving our students in our high schools an
2 alternative that gives them a path to the
3 middle class, a path to a great lifestyle, and
4 frankly teaches them a trade every bit as useful
5 and important as that which you'll learn in any
6 college, is important.
7 So again, to Senator Weber, thank
8 you for introducing this bill. It's going to
9 open up opportunities for children across
10 New York State, and for generations to come.

21 came from the trades, somebody that went to a
22 BOCES program in high school -- which is very,
23 very important -- I'm a huge advocate for our
24 BOCES programs to start coming into the trades.
25 And this is just something that when I went

1 through the apprenticeship program with
2 Plumbers Local 200 back in the day, it was so
3 important that from BOCES, went into the trades.
4 This is something that we need to
5 promote more because, again, just like what
6 Senator Martins has said, college isn't for
7 everybody. And guess what? Everybody needs to
8 go, everybody in this chamber, with our school
9 districts to advocate for our BOCES program and
10 then for our students, then to help get into the
11 New York State building trades. The real, real
12 apprenticeship programs that graduate our
13 apprentices. Not ones that are bogus.
14 So this is very important.

10 Our planning and zoning boards have
11 an incredibly important role in shaping the
12 character and the success of our communities.
13 They also play a really important role in making
14 sure that our communities are set up to be
15 successful in our fight against the climate
16 crisis.
17 With all of the things that we are
18 passing in this Legislature, making sure that we
19 are hitting the goals of the CLCPA, and the
20 number of different grants programs that exist
21 and the number of different best practices that
22 are being created, it can be difficult or
23 confusing or very cumbersome to be able to track
24 all of the different things that are out there
25 and available for each individual small town to

1 access.
2 With new grants for technology, for
3 equipment, for roadscapes coming from the federal
4 government and the state government, we should be
5 helping our municipalities -- specifically, our
6 planning boards and zoning boards -- make sure
7 that they have access to all of the resources
8 that are available to them to make the best
9 decisions for their communities.
10 This bill will provide an hour of
11 training for our municipal boards to really
12 understand and learn all of the different tools
13 that are available to them and the different best
14 practices that different businesses or homes
15 should take.
16 I want to thank a number of experts
17 that helped us with this bill, including
18 Brigid Walsh, an environmental planning expert
19 who helped us come up with some of the language
20 in this bill.
21 And I am happy that it is passing

4 and DMV.
5 Today, with passage of the bill
6 before us, we add yet another layer of protection
7 and empowerment by ensuring that any
8 identification materials taken from an individual
9 at the time of their incarceration are returned
10 in whole at the time of release.
11 Spelling this procedure out in
12 statute is important, as process and norms do not
13 have the same force and effect and many have
14 reported issues with retrieving all of the
15 articles that were seized at the commencement of
16 their period of incarceration.
17 This is a simple but necessary
18 measure of fairness. I proudly vote aye.

11 three-year-old, she attended an amazing school in
12 Syracuse called Jowonio, where they had a daycare
13 program together with an actual school. And it
14 included kids with all level of abilities,
15 including some with very severe developmental
16 disabilities.
17 As a parent, I was so impressed with
18 how seamlessly inclusive this school was and how
19 much the kids were able to learn from each other
20 and how well the teachers worked with them.
21 But as a parent I didn't realize
22 just how unseamless the administration of this
23 school was, because the daycare was regulated by
24 OCFS and the school part of it was regulated by
25 SED. And they had very different labor

1 requirements. The length of the day was actually
2 different for the teachers in daycare and the
3 teachers in pre-K. And the background checks had
4 to be done differently, and there were all kinds
5 of ways that it was really hard to administer
6 this school that was such a wonderful opportunity
7 for the kids and their parents.
8 And so we are streamlining this with
9 this bill. I'm very proud that we are making it
10 possible for schools like Jowonio all across the
11 state to operate in a much more rational manner
12 so that they can provide this kind of service for
13 kids and parents everywhere.

5 groups in our areas that do great work in
6 preserving our natural states of our wetlands.
7 However, this bill allows for foreign entities to
8 come into areas that may not be familiar with the
9 local landscape and may have an agenda that has
10 have nothing to do, quite honestly, with ensuring
11 that people get to still enjoy the use of and
12 access to those lands.
13 We have issues right now in
14 navigable waterways where there are folks that
15 would like to continue to enjoy that navigable
16 waterway and others that would like to see it
17 turned into a swamp or a wetland.
18 I don't think it's anyone's
19 intention; however, this bill will allow for
20 that. And I have concerns about the use of our
21 very economically important navigable waterways,
22 so I'll be voting no.

22 very useful tool for many older New Yorkers
23 living on fixed incomes, as it helps them as well
24 as people with disabilities by paying their
25 Medicare Part B premiums, approximately $200 per

2 prescription drug subsidy program that can be
3 worth up to $5,300 a year.
4 However, as is the case with so many
5 of our benefit programs, there is a separate
6 application and review process strictly for the
7 Medicare Savings Program. This is onerous,
8 time-consuming, and leads to many people missing
9 out on the benefit.
10 This bill treats any application for
11 Medicare Part D coverage as a de facto
12 application and presumed eligibility for the
13 Medicare Savings Program, consistent with a
14 review of appropriate Social Security data for
15 confirmation.
16 This bill will ensure that more
17 older New Yorkers secure savings in a way that
18 enhances their quality of life plus their health
19 and wellness.

11 authorized in Nassau County, because he wants one
12 at an intersection by a school in his community
13 because there have been accidents there and it

21 media specialists, are empowered to curate and
22 develop collections that provide students with
23 access to the widest array of developmentally
24 appropriate materials available to participating
25 schools.

4 SENATOR MAY: Through you,
5 Madam President. This is about codifying current
6 practice through which we put the responsibility
7 on trained professional school librarians to use
8 their knowledge and judgment to decide what kinds
9 of materials are developmentally appropriate to
10 kids in different levels -- different grade
11 levels. And to -- let me also add, to follow the
12 policies of the school board in terms of what
13 kinds of materials are appropriate.
14 SENATOR MURRAY: Madam President,

23 the parents involved in any way in this process?

25 SENATOR MAY: The parents elect the

2 SENATOR MURRAY: Thank you.
3 Madam President, on the bill.
4 ACTING PRESIDENT PERSAUD: Senator
5 Murray on the bill.
6 SENATOR MURRAY: I love that
7 answer, by the way, because it is the parents
8 that elect the school board.
9 But in this bill it doesn't
10 necessarily -- the school board doesn't
11 necessarily have a say.
12 But with that said, I want to
13 clarify something before we go any further,
14 about -- and it was the first question I asked.
15 Which libraries are we talking about? These are
16 school libraries, not public libraries. And
17 that's a major important difference.
18 The patrons of a public library are
19 all of us, everyone, man, woman and child. The
20 patrons of school libraries are children, period.
21 None of us. We don't go to a school library to
22 get our materials. Children go there. And
23 that's a very, very important point when it comes
24 to this particular issue.
25 Now, in the justification memo for

1 this bill I see that we jump on the very, very
2 popular current trend of using that wonderful
3 word "ban" or "banning": "The current wave of
4 efforts around the country to ban books from
5 libraries and classrooms."
6 There's a big difference between
7 banning something and restricting something. I
8 say that because established in 1968 -- let me
9 start by saying this. I wouldn't think I would
10 ever turn to this place for conservatism or
11 anything like this, but the bastion of
12 conservatism Hollywood, California, established
13 in 1968 -- that's 56 years ago -- the film rating
14 system provides parents with the information
15 needed to determine if a film is appropriate for
16 children.
17 Now, a lot of people don't know
18 this, but the ratings are determined by the
19 Classification and Ratings Administration, CARA,
20 via a board comprised of an independent group of
21 parents. Now, I don't see good old Bobby DeNiro
22 up complaining about banning movies in Hollywood.
23 I don't see all these people that are running
24 around saying we're banning books because we're
25 actually questioning the appropriateness of some

1 books in schools -- not in a public library. I
2 think everything should be available in a public
3 library as long as it's in the appropriate
4 section and not in the hands of children when
5 inappropriate. But again, a school library is
6 for children.
7 Now, I bring up the ratings system
8 in Hollywood because you had mentioned that
9 the -- in this bill it's going to be -- and let
10 me say I have the utmost respect for librarians,
11 media specialists, all of them. They're highly
12 educated. They do a great job. However, they're
13 not supposed to do the job of parents. Parents
14 need to have a say of what their children are
15 exposed to in schools. And yet, especially in
16 this bill, they will not.
17 Now, in my district I have 10 school
18 districts. One particular school district, it
19 was the school librarian who tweeted out her
20 pleasure in adding a couple of books to the
21 school library shelves: All Boys Aren't Blue and
22 Gender Queer.
23 Most parents didn't know anything
24 about this. Now, these are books that we've all
25 probably heard of because these are two of the

1 ones causing controversy right now.
2 When this tweet went out, parents
3 started looking into it, and they found out what
4 was in it. Now, I'm not going to read any
5 excerpts. I've got excerpts from these books.
6 I've got pictures, illustrations from these books
7 that if news were to cover it, they'd have to
8 blur them out. They'd have to block out some of
9 the language in here as well, because they
10 wouldn't be allowed to air it. That should tell
11 you something.
12 But I'll tell you the subject matter
13 of Gender Queer is a memoir. And she
14 particularly was happy about this. It's a memoir
15 about a teenage boy who fantasizes about having
16 sex with his older male cousin. That's what the
17 book's about on the school library shelf.
18 If anybody is uncomfortable, by the
19 way, think about how the 14-, 15-, 16-year-old
20 kids are feeling.
21 I go back to the movie rating
22 system. If these books were a movie, do you
23 realize that half of the kids in the school
24 wouldn't be allowed to get in? The movie rating
25 system has five ratings: G, PG, PG-13, R and X.

1 The R does not stand for "banned." It stands for
2 "restricted." What it means is under 17 years of
3 age are restricted from seeing this movie. They
4 cannot see it. And why? Because this group, the
5 ratings system of parents, has deemed it
6 inappropriate for children.
7 However, with that said, if a parent
8 thinks that it is appropriate, they are perfectly
9 welcome to bring their child there, just as with
10 these books. If a parent thinks that it is okay
11 for their children, they can get it from the
12 public library or they can buy it online and give
13 it to their child. There's nothing preventing --
14 the book is not banned. It doesn't disappear.
15 That's my point. We're not banning it, we're
16 restricting it.
17 And all I'm saying here is with this
18 particular book, I think there needs to be more
19 collaboration. Rather than saying we're going to
20 give it to this person to decide, there needs to
21 be a system where parents have input, the school
22 board has input. Yes, the media specialists, the
23 librarians have input. But what we can't do is
24 we can't shut out the parents' input. We need to
25 hear from them.

1 And by the way, back to the banning
2 part. We've heard a lot about, all across the
3 country, parents demanding books are removed for
4 all of these crazy reasons. And some of them are
5 crazy reasons. But that doesn't mean they're
6 being pulled from the shelves, it just means that
7 they came and complained.
8 There's nothing wrong with them
9 complaining, even if we might think their
10 argument is ridiculous, as long as there's a
11 system in place to weed through what is and isn't
12 so we get to the point where it's appropriate.
13 And that's all we're asking here. We need
14 parental involvement. We can't be shutting the
15 parents out.
16 For that reason, I'll be voting no.

25 first of all, thank Senator Murray for his

1 questions and for having voted for the identical
2 version of this bill last year, and say that as a
3 parent I sent my child to school to be taught by
4 people who were not the parents of the kids in
5 the school, that were trained and had skills and
6 experience to provide a curriculum that I could
7 not provide in my home.
8 And I think the librarians in
9 schools also serve that purpose. They bring a
10 whole world of knowledge and experience to their
11 decision-making in terms of what books might be
12 appropriate for the kids in the school. And yes,
13 it's not a public library, but in a public school
14 it is a public service that they are providing.
15 And a good school librarian provides
16 kids with a whole world of reading opportunities
17 with books with that can challenge them, open
18 their horizons, make them feel less lonely or
19 isolated, make them more compassionate or
20 understanding. Or maybe just inspire them to
21 read more, which is one of the primary goals of
22 school librarians.
23 I found a book in my junior high
24 library that was called Simple Justice. It was
25 about the events leading up to the landmark

1 Supreme Court case Brown vs. Board of Education,
2 which had its 70th anniversary last week. That
3 book changed my life. It inspired me to work for
4 civil rights and educational equity, work that I
5 believe I'm still doing today.
6 These days there are places in this
7 country where this book could face banning and
8 expunging from the school library because of its
9 eloquent descriptions of the fight against school
10 segregation and the profound racial injustices at
11 the core of school segregation.
12 Across the country we are seeing
13 school board meetings being hijacked by a few
14 vocal people. Often they are not parents or even
15 residents of that district. But they are pushing
16 extreme political agendas at the expense of the
17 children, parents and librarians who support the
18 freedom to read a diverse array of
19 age-appropriate material.
20 We know that the large majority of
21 parents prefer for their kids to have a broad
22 range of opportunities to read in their school
23 libraries as well as their public libraries.
24 This bill aims to defend that freedom and to
25 support the dedicated library professionals who

1 will make it possible.

18 specific as to what they look like. I will trust
19 teachers and professionals to teach.
20 I will also rely on the fact that we
21 have our school boards and our local school --
22 local voters and populations who vote for school
23 board members being able to express their wishes
24 and their policies through those school boards in
25 order to make sure that the preferences and

1 priorities that are set by the community are
2 reflected in the policies of the school itself.
3 That's part of how I understand that
4 the process works. And as a result,
5 Madam President, I'll be voting aye.
