7 Madam President.
8 I have often said on this floor
9 there will be no piece of legislation --
10 ACTING PRESIDENT PERSAUD: Can we
11 have some quiet, please. Thank you.
12 SENATOR BAILEY: Thank you,
13 Madam President.
14 I have often said on this floor, or
15 alluded to it, but I'll say it definitively,
16 there is nothing I will do on this floor or in
17 any capacity that will, you know, come close to
18 what being a dad means to me.
19 And so a good friend of mine,
20 Kevin Riley, the City Councilmember, he told
21 me -- he said, "Look, I got this really dope
22 group of brothers who are doing really positive
23 things. We call ourselves The Dad Gang."
24 And here in the gallery today we
25 have Edward Smith and Sean Williams, some of the

1 cofounders of The Dad Gang.
2 And sometimes out of pain comes
3 purpose. So in 2016, Sean was in a supermarket
4 in Long Island, and he was with his children,
5 with his second child. And someone delivered the
6 backhanded of backhanded compliments, and said,
7 "It's good to see that you're still in the life
8 of your child."
9 Well, like Sean would say, and I'll
10 say, what the hell does that mean? Because if
11 you ask the CDC, Black fathers are not only more
12 likely to be involved in their kid's life,
13 they're more likely to help out with homework,
14 more likely to help out with -- excuse me, more
15 likely to have meals at the table, so on and
16 so forth.
17 So why is there a consistently
18 negative portrayal of Black fathers? Why? Well,
19 when you have a problem, you find the solution.
20 And Edward and Sean and Kevin and so many
21 brothers from The Dad Gang, they found the
22 solution. They decided to flood your timeline
23 with positivity. It started out as an Instagram
24 account with simply just positive things about
25 Black fatherhood. And it grew.

1 It grew to, in 2018, they had their
2 first March of Dads. It was in Brooklyn.
3 And what was happening is that you
4 get a bunch of brothers together and they're
5 pushing their strollers and they're showing the
6 positive messaging of what Black fatherhood is.
7 And since then, The Dad Gang has
8 taken off to a global phenomenon. They've been
9 recognized by Oprah. Oprah don't -- Oprah
10 doesn't just -- if you just recognize people
11 that's not doing anything, Madam President. We
12 know that.
13 Steve Harvey. Will Smith. Dove.
14 So many other organizations have contributed.
15 This year the March of Dads is sponsored by LEGO.
16 So you have -- now we're at this intersection
17 where corporate America and big folks are seeing
18 what we've been trying to tell you the whole
19 time, that the message has been distorted.
20 And I'm grateful that we have
21 brothers like you to kind of course-correct that
22 messaging.
23 Sean also was the winner of the
24 NAACP Unsung Hero Award in the wake of the
25 George Floyd March.

1 But I can tell you what they've done
2 in my district, Madam President. In the height
3 of COVID, when people were unsure about what they
4 were going to do, how they were going to take
5 care of their kids, they pulled up in Co-Op City
6 with an 18-wheeler truck and gave fathers
7 strollers and other baby products. Committing
8 what we call Random Acts of Dadness, as I would
9 say, Madam President.
10 And what they don't know -- and I
11 was waiting to say this on the floor -- now I
12 recently became a father for the third time this
13 past April. And in the delivery room I wore a
14 Dad Gang shirt. I wore a Dad Gang shirt that
15 said "Allow me to reintroduce myself." And it
16 said "Dope Dad" on it. And the -- and one of the
17 nurses said, "What's that shirt?" And I told her
18 exactly what it was. We're redefining what y'all
19 think about Black fathers. We are active. We
20 are present. We are there.
21 Most importantly, The Dad Gang is a
22 community. Right? It's truly a community that
23 allows us to be able to have conversations that
24 we may not know. We can ask brothers, Hey, how
25 do you deal with this? Like Kevin Riley, right,

1 he had a son before me, so now I call Kev: "Hey,
2 you have two daughters and a son. What's this
3 boy going to be like?" That's what this is
4 about.
5 So I would encourage you that if you
6 happen to be in Los Angeles on June 16th, join
7 the March of Dads. If you happen to be in the
8 Bronx on June 29th, like I will, join the March
9 of Dads. If you happen to be in Washington,
10 D.C., on August 4th, join the March of Dads. If
11 you happen to be in Atlanta on September 19th,
12 join the March of Dads.
13 These brothers are doing really
14 positive things that they -- that they'd like to
15 put as a footnote. But we want to make sure,
16 again, that this becomes the whole story.
17 So Madam President, I thank you for
18 this time and I would appreciate it if you would
19 give -- extend all of the privileges and
20 courtesies of this house to Edward Smith and
21 Sean Williams, the founders of The Dad Gang.

12 Many of our housing challenges in
13 the upstate cities stem from the fact that we
14 have some of the oldest housing stock in the
15 nation. In Buffalo, there is barely a house that
16 was built after the weatherization standards came
17 in in 1980. It leads to higher utility bills
18 that make homeownership and apartment rental more
19 expensive. As we saw during our deadly blizzard
20 of 2022, poorly insulated homes can become very,
21 very dangerous in extreme weather conditions.
22 The power goes out, the house gets cold --
23 dangerously cold -- fast.
24 A properly insulated house can stay
25 above freezing for four days. A home insulated

1 to modern standards can save lives. New York
2 State has a lot of programs to help homeowners
3 reduce the cost of insulating their homes, but
4 they're wildly underutilized. There's a couple
5 of reasons for it: You have to get an up-front
6 cost, you have to pay the up-front cost. If you
7 do it wrong, you don't get your rebate.
8 Sometimes it's a rebate; sometimes it's a credit.
9 A lot of anxiety around the
10 programs. You know, people have said you need a
11 CPA to get through one of these programs. So
12 creating a more effective way than incentives to
13 insulate houses will help all New Yorkers because
14 it will help us reduce our utility costs.
15 So we've come up with a plan to
16 allow us to scale our statewide insulation
17 efforts. This bill would allow the -- change the
18 Public Service Law so that we can task utility
19 companies with leading the effort to do
20 insulation programs -- large-scale insulation
21 programs, not one-offs, but block after block.
22 We could do it the same way the utilities come
23 and upgrade your meters. It will make a
24 large-scale insulation upgrade possible by
25 amortizing the cost over 25 years.

1 While developing this plan we spoke
2 to some of the major utilities. They said it was
3 feasible. To be honest, they weren't wild about
4 it, but they said that they could do it. They
5 already have a highly trained, unionized
6 workforce, and we can transition that workforce
7 into doing insulation of homes. They estimate
8 that they could reach 20,000 homes in a service
9 area over 10 years. We've estimated that it will
10 save customers over $16 million over a 10-year
11 period on their heating bill. That's just in
12 Buffalo alone.
13 It will also help low-income
14 New Yorkers because throughout upstate, one of
15 the hidden causes of eviction are utility bills.
16 Your rent seems very reasonable in September and
17 October, and in December, holy cow, your utility
18 bill is higher than your rent. It leads to
19 evictions as people are faced with the dilemma,
20 do you pay the rent or do you pay your gas bill.
21 So this bill will benefit New York
22 as a whole. It will reduce our state's energy
23 usage. And that's a win for all of us. You
24 know, as we say, the best electron is the best
25 electron that we don't burn. The less energy we

1 use as a state, the less we have to add to our
2 electrical grid.
3 And that passing the costs on to the
4 ratepayer, it's standard practice in the utility
5 world, but this will allow the ratepayers to
6 actually benefit from that cost. So the cost of
7 the insulation spread over the rate will be much
8 less than the savings that will passed on to the
9 consumers.
10 This will be the first time we've
11 used this strategy to make infrastructure
12 improvements around the state. And we are
13 treating installation like infrastructure
14 improvements. So this bill will have a major
15 impact on housing affordability, eviction
16 prevention and energy reliability, all at the
17 same time.

24 In the last few years Central
25 New York has been rocked by the closure of two

1 small colleges that were each integral parts of
2 their local communities for about a century and a
3 half. They were major employers, important
4 economic drivers, and embedded in the culture of
5 the villages where they were situated.
6 They were also critical to the
7 functioning of their local governments. Wells
8 College, in Aurora, didn't just employ faculty
9 and educate students, it also housed the
10 village's water treatment facility, an elementary
11 school, and the main healthcare facility in the
12 region.
13 When I attended the final graduation
14 ceremony two weeks ago at Wells, one of the
15 graduating students spoke about her experience as
16 a volunteer firefighter while she was a student
17 at Wells. And the mayor, who was sitting next to
18 me, leaned over and said that about a quarter of
19 the volunteer fire department was made up of
20 student volunteers, and they have no idea, moving
21 forward, how they're even going to staff their
22 fire department.
23 When a community is hit by a major
24 storm or a natural disaster, the Governor can
25 declare a state of emergency, activating

1 resources from state agencies to do what they can
2 to help out.
3 This bill acknowledges that a
4 college closure is akin to a natural disaster for
5 its host community and it requires several state
6 agencies to step forward and provide assistance
7 with recovery.
8 I hope this will help some of these
9 communities, and I hope there won't be too many
10 more communities that need this help in the
11 future.

11 You know, New York's warehousing
12 industry is growing rapidly. Since passing the
13 Warehouse Worker Protection Act in 2022 to
14 disclose algorithms to workers, Amazon increased
15 its footprint by 14 percent in New York State --
16 and that's in 2022 alone -- and still continued
17 to see double-digit profit margins.
18 This kind of growth is at the
19 expense of the literal physical and mental health
20 of warehouse workers. These warehouses are now
21 effectively high-tech sweatshops. Injury
22 rates are spiking because workers handle poorly
23 designed equipment, they use stressful postures,
24 and they move unsafe loads. Warehouse workers
25 are injured four times more than in any other

1 industry in New York State. One in 11 New York
2 warehouse workers are injured on the job
3 annually, making it the most dangerous job in
4 New York.
5 Our warehouse workers injury rate is
6 54 percent higher than the national average.
7 Workers from ALB-1, an Amazon warehouse just down
8 the road from this very same building, shared
9 stories of how they got injured on the job and
10 went to visit Amcare, the on-site medical staff.
11 They got a pat on the back, an Advil, and were
12 returned to work immediately.
13 Look, employers have shown us that
14 they are not going to regulate themselves. The
15 predatory e-commerce industry churns through
16 workers often with no regard for their
17 well-being. Amazon alone has an annual turnover
18 rate of 150 percent. They treat workers like
19 they're disposable, and absolutely no one is.
20 We cannot sacrifice working people's
21 health, their ability to pick up their child or
22 carry groceries, simply for the mere convenience
23 of 24-hour package delivery.
24 This bill advances the work that we
25 started with the Warehouse Worker Protection Act,

1 and we will keep working to ensure that our
2 worker protections keep pace with the changing
3 realities of work.

17 The for-hire industry in the City of
18 New York has been devastated since 2018 when TLC,
19 in their infinite wisdom, decided to put a
20 moratorium on applications. What has happened,
21 that moratorium was extended during COVID. And
22 since COVID, since we've got this under relief,
23 they have not been allowed to reapply or not even
24 reapply, but to resubmit what they already had.
25 During COVID they lost their ability

1 to apply for their licenses, and the industry
2 went from approximately 14,000 drivers in 2018 to
3 about 6,000 drivers today. It is an industry
4 that is hurting. The for-hire-vehicle people
5 that -- individuals that work in that industry
6 have lost their ability to make money. It has
7 impacted their families.
8 It is only fair for TLC to treat
9 them the right way and allow them to resubmit
10 their applications -- not treat them like new
11 applications, but allow them to resubmit, those
12 6,000 that remain, so they can continue to
13 cooperate -- continue to contribute to the city
14 and to people in our communities that use
15 for-hire vehicles, and most other communities.
16 So I vote in the positive, and I
17 hope that this will help this segment of the
18 for-hire industry that is really in need of
19 assistance. Thank you.

17 Earlier this year I was able to tour
18 my local 988 call center, operated in Monroe
19 County by the Goodwill of the Finger Lakes. I
20 have to say I'm in complete awe and appreciation
21 of the work that these call center operators are
22 doing to manage the incoming calls from the 988
23 crisis lifeline.
24 One of the interesting things I
25 learned is that the vast majority of these calls

1 are actually resolved right there by talking to a
2 crisis counselor, which tells us that sometimes
3 just calling 988 and speaking to a crisis
4 counselor can be the difference between life and
5 death for folks in crisis.
6 That is why we've pushed so hard for
7 this legislation that will require that
8 institutions of higher education establish an
9 education campaign about the 988 suicide and
10 crisis lifeline and start to include its
11 information right there on student I.D. cards.
12 We know, as our Surgeon General has
13 pointed out, we are in the midst of a youth
14 mental health crisis. Many students, when they
15 go off to college, are without the supports that
16 they are used to at home. It's a particularly
17 challenging time.
18 And that's why I'm so grateful to my
19 colleagues for once again passing this bill so
20 that we better address the youth mental health
21 crisis.

6 I'm rising to vote no on this
7 legislation, because we talk a lot on the floor
8 about transparency and open government and how
9 this is -- we want to shine more light on
10 governmental lobbying and so forth. And this
11 bill is the exact opposite, in fact.
12 This is reducing transparency to
13 allow now larger nonprofits to lobby without
14 registering -- it makes zero sense, quite
15 frankly. And we've seen lately, in recent years,
16 we've had nonprofits lobbying for various issues
17 far beyond the scope of their nonprofit charter,
18 and they're doing it with impunity.
19 So quite frankly, this is not a good
20 bill, and I'm really surprised to see it come
21 through this chamber. And for those reasons and
22 many others, Madam President, I'm voting no and I
23 ask my colleagues to do the same.

17 Madam President. I rise to explain my vote on
18 this legislation.
19 What it does is that it enacts some
20 critical protections during a divorce to ensure
21 that if one spouse is sued in a way that affects
22 the marital estate, then that spouse must inform
23 the other spouse.
24 Effectively, this legislation will
25 safeguard marital assets during a divorce by

1 requiring the other party to be informed of
2 things such as tax liens, foreclosures,
3 bankruptcy or litigation that could adversely
4 affect the marital property, and preventing
5 either party from disposing of marital assets
6 before their case is completely resolved.
7 The bill also provides clarification
8 in law for periods when the Governor, for
9 example, has declared a state of emergency, like
10 a pandemic, that effectively shuts down the court
11 system. In such instances, a spouse will be
12 prevented from physically filing a summons with
13 the court.
14 An alternate procedure would be in
15 place to ensure that both parties would be
16 prohibited from doing things that would diminish
17 the marital estate like spending lots of money or
18 taking on a lot of debt.
19 Madam President, by passing this
20 legislation we can help to ensure that both
21 parties are treated fairly during a divorce
22 proceeding. I vote aye and encourage my
23 colleagues to do the same.

8 Madam President. Senator Gianaris, I'm sure
9 you're aware that I'm not really an acolyte of
10 the philosophy that everyone should be forced to
11 vote. But I'm just curious, this bill is so
12 broad -- when you talk about something like the
13 DMV, we have 16-, 17-year-olds that can get
14 licenses, how will we prevent them from being
15 automatically registered to vote?
16 SENATOR GIANARIS: Well, the
17 Department of Motor Vehicles knows the age of the
18 applicant, and so they would have a screen -- in
19 fact, those individuals would be pre-registered
20 to vote, because that's permitted under the law.
21 And when the DMV is aware of what
22 their age is and clarifies that they are
23 otherwise qualified to vote, they would transmit
24 the relevant information to the Board of
25 Elections for processing.

9 being said, as you're aware, in New York State
10 people that are not citizens are allowed to get
11 driver's licenses. Is there -- what is the
12 protection there that these people will not
13 automatically be registered to vote?
14 SENATOR GIANARIS: I think as
15 Senator Borrello knows, there is already a law
16 that we have in effect -- that I suspect you
17 opposed at the time -- that provides for a
18 process whereby the DMV evaluates the
19 qualifications of an applicant for registration.
20 So for example, what this bill
21 provides is that if someone comes and presents
22 identification that clearly indicates that the
23 person is not a citizen, that information would
24 not be transmitted to the Board of Elections for
25 processing.

1 So for example, if, say, a Wookie
2 presents an I.D. from Kashyyyk, that would not
3 end up at the Board of Elections. That would be
4 screened out, because it's clearly not a citizen
5 of the State of New York.
6 But if the I.D. clearly identifies
7 the person as a citizen, that information would
8 go.
9 And if there is some ambiguity -- I
10 think the example you pointed out was a state
11 driver's license, which can or cannot be a
12 citizen -- then there is the existing process
13 where the applicant would have to attest to their
14 qualifications to vote.
15 SENATOR BORRELLO: Madam President,

2 of being registered.

11 back to what we talked about with those folks
12 that are not citizens of New York State or the
13 United States having to opt out.
14 But back in 2022, if I'm not
15 mistaken, we decriminalized not opting out. Now
16 we're going to automatically register people,
17 we're asking them to I guess opt out voluntarily,
18 but there is no criminal penalty if they don't.
19 How do we address that?
20 SENATOR GIANARIS: First of all,
21 this bill does something that I would think you
22 would support, which is it changes the current
23 process.
24 Currently, if someone -- well, the
25 board doesn't have the process in place yet. But

1 the current law provides that if someone presents
2 an I.D. that is clearly indicating the person is
3 not a citizen, they still would have to attest to
4 the fact that they're not and opt out of
5 registering at that point.
6 This bill would end the process
7 there. The DMV would have a screen that says if
8 you present a foreign passport -- or a foreign
9 driver's license or what have you -- that
10 indicates you're not a citizen, there would be no
11 transmittal, no further attestation required.
12 That application would be dead for voter
13 registration purposes.
14 As it relates to ambiguous
15 identification, which we just talked about, the
16 same process that is currently in the law would
17 be in place that would require an attestation.
18 Federal law would still apply no
19 matter what we do or what we say here in
20 New York. And so if someone violates federal law
21 by falsely registering to vote, attesting to be a
22 citizen, then that's still punishable.
23 SENATOR BORRELLO: Madam President,

7 commonsense bills don't get very far in this
8 chamber.
9 With that being said, how do we
10 determine -- how do we determine these two
11 locations, DMV and people that collect Medicaid,
12 why those two locations? A lot of people
13 interact with government in so many places where
14 there would be an opportunity to register more
15 people. Why those two locations?
16 SENATOR GIANARIS: Well, DMV
17 because it is the most frequently -- frequented
18 state agency. It's why we've had what we call
19 the Motor Voter Law for about 30 years. DMV is
20 always seen as the most effective point of entry
21 for voter registration purposes.
22 Medicaid is simply because it would
23 accommodate a lot of your concerns. One would
24 have to attest to citizenship and be qualified as
25 a citizen to qualify for that program. And so we

1 know that those applicants -- we avoid all the
2 questions you raised because the applicants, by
3 definition, would be citizens.
4 SENATOR BORRELLO: Madam President,
5 on the bill.

9 Senator Gianaris. Appreciate the engagement
10 today.
11 I think the fundamental issue I have
12 with this bill is that we are saying you will be
13 registered to vote. If you interact with
14 government at the DMV or in getting Medicaid, you
15 will be registered to vote. And there is a
16 process to say no, I don't wish to be.
17 This is still the United States of
18 America, and if people choose not to vote, they
19 don't have to vote. But we're going to compel
20 people to be registered to vote. Now, people
21 tell me, I don't register to vote because I don't
22 want to be called for jury duty or I am concerned
23 about information -- whatever the reason is.
24 By the way, I think it's everyone's
25 duty and responsibility to vote. I think you

1 actually forfeit your right to complain if you
2 don't vote. But that being said, it is still a
3 free country and you shouldn't be compelling
4 people to do this.
5 But then it's interesting that we've
6 chosen the DMV, where we allow folks that are not
7 citizens to get driver's licenses -- there's no
8 criminal penalty for not opting out currently --
9 and those folks that are reliant on government
10 for something as basic as their healthcare.
11 What about the other places that we
12 interact with people? The pistol permit office,
13 Office for the Aging, the Department of Veteran
14 Services -- so many places where people interact
15 with government. They may have a different
16 opinion of government based on the fact that
17 they're not there entirely for reliance on
18 government for their basic survival.
19 So that's my concern. My concern is
20 we're kind of, you know, putting our thumb on the
21 scale here. But most importantly, we're telling
22 people, You will be registered to vote in
23 New York State. If you're going to interact with
24 government, we want to make sure that you're
25 registered to vote.

1 And that is a fundamental violation
2 of basic rights, in my opinion, so I'll be voting
3 no. Thank you.

25 I appreciated the debate with my good colleague

1 Senator Borrello.
2 Once again, I'm forced to point out
3 that so much of his arguments fall -- come down
4 to wanting fewer people to vote.
5 And this is a simple -- I don't know
6 if Senator Borrello has ever engaged in a voter
7 registration drive, but all the criticisms he
8 just leveled at this bill would apply to himself
9 or any civic agency or Lions Club or anyone
10 that's trying to register people to vote. My
11 God, do they know who the person is? Are they
12 looking at citizenship papers in those
13 situations? I doubt it.
14 But those people would eligible to
15 vote as long as they fill out their form, attest
16 to their qualifications and submit it.
17 This is just doing it on a grand
18 scale, where we make it easier for people to
19 register to vote so that they can avail
20 themselves of their democratic right.
21 I don't know why Senator Borrello
22 hates democracy, but he proves it over and over
23 again in this chamber by arguing against people's
24 rights to go to the poll booth, whether it's
25 early or voting by mail, which of course we can

1 now do. You're welcome. Because I know my
2 colleagues were against it at first, and now
3 they're trying to encourage everyone on their
4 side to also vote by mail.
5 But the fact is this Majority has
6 made it a point to open up the democratic process
7 to all qualified voters, make it easier for them
8 to register, make it easier for them to vote, and
9 we're all the better for it.

17 So I don't think it's a matter of
18 not wanting people to vote. You know, just a few
19 days ago we were all marching in parades and
20 celebrating Memorial Day, honoring those who
21 fought and gave their lives to this country to
22 protect our rights.
23 And one of the most sacred rights we
24 have is that of voting. The very thing that we
25 can so is take that extra step to make the effort

1 to register to vote. Instead, the nanny state
2 steps up and says, no, we're going to do
3 everything for you. So we're going to
4 automatically register you, including those who
5 come here illegally. Which opens the door to
6 possibility of fraud.
7 So it's not a matter of not wanting
8 people to vote. It's not wanting people that
9 aren't supposed to vote to vote. But also how
10 about we show some respect to those veterans who
11 gave their lives and make just the tiniest of
12 effort. Because almost any government building
13 you go to, you can find a voter registration
14 form.
15 I took -- one day I compared
16 registering to vote compared to the steps of
17 registering your vehicle. It was three times
18 harder to register your vehicle than it was to
19 register to vote. It's one of the simplest
20 processes you can do.
21 Just make the effort, and that way
22 we know the people that are trying are supposed
23 to be able to vote. Because if someone who's not
24 here legally tries to register, they will be
25 denied.

13 going to kind of tie the hands, in some cases, of
14 our utility companies when it comes to call
15 centers. But, you know, many of these utility
16 companies operate in many places -- other areas
17 of the state, other states.
18 So I guess the question is, would
19 this bill -- my first question is, would this
20 bill prohibit someone that has more than one
21 service territory from, you know, kind of
22 utilizing those services -- in a disaster, being
23 able to shift, on the fly, to another facility
24 should there be, you know, an issue like a storm,
25 something that would prevent that call center

1 from being able to operate?
2 SENATOR MANNION: So what this bill
3 will do -- Madam President, through you -- will
4 formalize the process when a call center utility
5 company is starting the process of moving a call
6 center or closing a call center.
7 That is the expectation as far as
8 the process where this is planned. It does not
9 address what may occur in an emergency situation.
10 SENATOR BORRELLO: Madam President,
11 will the sponsor continue to yield?

23 through you. To address your concern, Senator, I
24 would say that there is already in law a process
25 that must go through the PSC when there is going

1 to be a call center moved. But this just more
2 formalizes the process.
3 So currently -- again, I'm speaking
4 hypothetically here, but I would assume that if
5 there was a natural disaster and a call center
6 had to respond, the physical location of that
7 call center may have to be adjusted.
8 I would assume also that if this
9 bill was enacted into law, in an emergency
10 situation, that the physical location of that
11 call center may not matter. But the individuals
12 that are functioning in the capacity of the call
13 center would matter, and therefore they would
14 still be able to do their job regardless of the
15 actual physical location being changed
16 temporarily.
17 SENATOR BORRELLO: Madam President,

3 different state in an emergency situation, but
4 they'd have to use the employees within New York
5 State to make those calls?
6 SENATOR MANNION: Through you,
7 Madam President, this is addressing the issue of
8 current call centers that are already established
9 in the state.
10 So if I understand the Senator's
11 question correctly, if there are call centers
12 dealing with utility customers within New York
13 State that are located out of New York State, I
14 believe it would not impact those call centers
15 outside of the state.
16 SENATOR BORRELLO: Madam President,

24 really kind of dealing with staffing levels. And
25 aren't those typically part of a collective

2 of, I guess, interfering in that collective
3 bargaining?

5 Madam President. What this does is establish a
6 few things in this piece of legislation. Number
7 one, what it does is make sure that if a utility
8 company wants to move a call center out of the
9 state, that the process is formalized, formalized
10 regarding timelines with a hearing and that
11 approval process.
12 Additionally, as it relates to the
13 Senator's question, there's a provision here
14 which would allow for utility companies to
15 establish a work-from-home policy. If they do
16 that, that must be collectively bargained before
17 anything is changed or implemented.
18 SENATOR BORRELLO: Madam President,
19 will the sponsor continue to yield.

2 for the utilities to have to hire more
3 call-center employees than what might be needed,
4 I'm guessing.
5 So how is this going to impact
6 ratepayers? I mean, is it a really good use of
7 ratepayer funds to essentially have to have more
8 call-center employees, you know, than really
9 needed?
10 SENATOR MANNION: Through you,
11 Madam President. On the last question, I'd just
12 like to address that it does not impact -- this
13 bill would not impact current collective
14 bargaining agreements.
15 And to answer the Senator's question
16 here, the bill does not address an increase or
17 decrease of employees at the call center. It
18 addresses a relocation or a closure.
19 SENATOR BORRELLO: Madam President,
20 if the sponsor will continue to yield.

2 really hefty fines in here; penalties are $50,000
3 per consumer inquiry and $150,000 per day that a
4 call center is closed. That seems like a pretty
5 hefty fine.
6 Where did that -- where did those
7 fines come from? What are they based on?
8 SENATOR MANNION: Through you,
9 Madam President. So there are already
10 established penalties in place through the PSC if
11 there's a violation of provisions similar to
12 this. So those penalties have not been altered
13 for several decades. And as a result, we made an
14 adjustment regarding the level of penalties if a
15 utility company knowingly fails to obey this
16 legislation.
17 SENATOR BORRELLO: Madam President,
18 on the bill.

22 Senator Mannion. I just wanted to try and
23 clarify some things. I appreciate that.
24 You know, I think we all realize
25 that utility rates are going up in New York

1 State. It's becoming more and more burdensome
2 for the average New Yorker. And really I think
3 here in New York we're doing a lot of things to
4 unfortunately increase those rates, requiring
5 more so-called green energy to be purchased by
6 utility companies, which is forcing them to have
7 to raise rates and ask for, in some cases,
8 double-digit rate increases.
9 And there's more than just providing
10 power when it comes to the services that are
11 delivered. We have to have all this
12 infrastructure in place, including these call
13 centers. And as anybody knows that's ever had
14 their -- that lost their power or their gas has
15 been off, contacting someone, a real live person
16 that you can talk to in an emergency, especially
17 when you're talking about something as basic as,
18 you know, the electricity being on in your home
19 or the heat being on in your house, is essential.
20 There's no doubt about it that having someone
21 there that can take your call, deal with your
22 problem and be able to give you some comfort is
23 essential.
24 But my concern is we're going to
25 make this -- we're going to force companies,

1 essentially, to start moving away from New York
2 with rules like this. And using things like, you
3 know, AI technology, we may have less and less
4 call centers and less and less people working in
5 call centers. So when utilities make decisions
6 as to where these places with real live people
7 that pay bills, that get paid, are going to be,
8 they may choose not to have them in New York.
9 And that is what troubles me a
10 little bit about this bill, so I'll be voting no.

22 I rise to celebrate this important
23 milestone that marks the 40th anniversary of the
24 Southern Tier AIDS Program. This community gem,
25 also known as STAP, has been contributing to the

1 Southern Tier in our state for more than
2 four decades. They provide education about the
3 important issues surrounding HIV, other STIs, and
4 AIDS. They have saved countless lives and
5 transformed many lives in that same regard.
6 In 1984, as the shadow of the
7 HIV/AIDS epidemic loomed large, a group of
8 committed citizens from my district in
9 Broome County, made up of healthcare
10 professionals, educators, clergy, community
11 activists, came together to form a coalition.
12 Their mission was clear: To combat the
13 devastating impact of HIV/AIDS in our community.
14 This coalition is what laid the foundation for
15 what would become the Broome County AIDS Task
16 Force, securing essential funding to establish a
17 beacon of hope and support for those affected.
18 From its humble beginnings, with a
19 simple hotline and resource directory, STAP
20 quickly became a cornerstone of support,
21 expanding its services as the needs of our
22 community grew. And under the capable leadership
23 of its executive director, John Barry, it has
24 evolved into a comprehensive healthcare service
25 organization, not only addressing HIV/AIDS but

1 also the broader health and social needs of our
2 community.
3 Their holistic approach encompasses
4 everything from prevention and treatment to
5 support services and ensuring those that are
6 affected by HIV/AIDS receive not just medical
7 care but the emotional and social support that is
8 necessary to lead fulfilling lives.
9 This approach has allowed them to
10 extend its impact far beyond traditional
11 boundaries, touching the lives of over 2,735
12 individuals directly affected by HIV/AIDS.
13 Moreover, their influence also
14 extends to our ongoing opioid crisis, with its
15 Narcan services saving 305 lives in 2023 alone.
16 Nearly a hundred families have received housing
17 assistance, while 5,400 individuals have
18 benefited from food aid -- which is a remarkable
19 111 percent increase in just two years.
20 The numbers not only highlight the
21 breadth of STAP's impact, but also underscore the
22 critical nature of their work. And as we
23 acknowledge the 40th anniversary of the Southern
24 Tier AIDS Program, we not only celebrate their
25 past achievements, but also reaffirm our

1 commitment to support their future endeavors.
2 Their journey from a grassroots
3 organization to a beacon of hope and resilience
4 is a testament to the power of community,
5 compassion and relentless dedication.
6 I want to thank you,
7 Madam President, for allowing me for speak on

9 all of us that service to the community
10 transcends the immediate; it builds a legacy of

23 of senior members of our community who have
24 contributed immeasurably to the fabric of our

1 In this chamber we have worked on a
2 variety of bills supporting our seniors, which we
3 know are vital and crucial for our communities in
4 terms of the contributions that they give every
5 single day. And this organization is embodying
6 those values.
7 In 1974, following the enactment of
8 the Older Americans Act, Broome County
9 established the Office for Aging, recognizing the
10 necessity to support our older citizens in living
11 with dignity and independence.
12 Over the decades this office has
13 exemplified dedication and compassion,
14 significantly expanding its services to meet the
15 growing needs of our seniors. Back in the
16 1970s -- that was before I was born --
17 (Laughter.)
18 SENATOR WEBB: -- the Office for
19 Aging provided over 2,000 information and
20 assistance contacts, 8,300 home-delivered meals,
21 79,000 senior center meals, and 15,000
22 transportation rides.
23 Today these numbers have soared,
24 reflecting both the growing demand and the
25 office's robust response. In 2023 alone,

1 18,219 information and assistance contacts were
2 made, 172,140 home-delivered meals were provided,
3 and 52,755 congregate meals were served. And
4 19,566 transportation rides were facilitated.
5 I am proud to recognize that members
6 of our older generations have not only built and
7 shaped our nation, but also have safeguarded the
8 freedoms and values ensuring better lives for
9 future generations. Their enduring legacy and
10 their ongoing contributions are essential to the
11 vitality of our state.
12 The evolution of their services,
13 such as the introduction of the Foster
14 Grandparents Program, Yesteryears, group respite,
15 and in-home personal care further illustrates the
16 Broome County Office for Aging's adaptability and
17 commitment to meeting the complex needs of our
18 aging population.

15 Today I proudly rise to recognize
16 the achievement of the Elmont Memorial
17 High School Boys Basketball Team in winning the
18 Class AA State Championship 51-44 over
19 West Genesee. We had wanted to get them up here
20 to the Capitol, but unfortunately our schedules
21 didn't work out. But this is such an important
22 resolution to recognize them for this
23 achievement.
24 The Spartans were a force all
25 season, finishing with a 23 and 4 record. And

1 while this team had their share of great
2 offensive performances, it was truly their
3 commitment to defense that led them to this state
4 title.
5 The Elmont Boys Basketball Team only
6 allowed opponents an average of 43 points per
7 game in the post-season, and that's coming
8 against the best competition in the state.
9 In the championship game they
10 limited their opponent to 33 percent from the
11 field and only two out of 19 three-point shots.
12 And the team did not have an easy
13 path to the title. In the Long Island
14 Championship Southeast Regional final, the
15 Spartans won a clutch buzzer beater to beat their
16 opponent by one basket, 53 to 41. Anyone who has
17 competed in high school athletics knows how much
18 every inch and every second can count when two
19 great teams are facing each other. And it takes
20 incredible determination to come away with this
21 victory.
22 The team was determined to bounce
23 back and reach their ultimate goal of ending the
24 season with the state title after making it to
25 the Nassau class A semifinal last season. And

1 this championship is a testament to the team's
2 dedication and hard work during the off-season.
3 This is also a testament to the
4 Elmont Boys Basketball Team's program as a whole
5 and the culture of excellence that has been
6 established to build the foundation for where
7 they are today. This is the team's second state
8 title, with their first coming in 2016. And I'm
9 look forward to more to come.
10 To the Elmont Memorial Boys
11 Basketball Team, to their coaches, their families
12 and the students in the community that have
13 supported them, and especially to the players, I
14 congratulate them on this state championship, and
15 I am proud to support this resolution to
16 recognize this victory.

13 chamber. It feels like I've debated it actually
14 more than five times, but I think it's only five.
15 So I guess my first question is, are
16 there any changes to this? Or is this still the
17 same bill that it was in 2020?
18 SENATOR CLEARE: Through you,
19 Madam President. Since I've been here, it has
20 not changed.
21 SENATOR BORRELLO: Madam President,

17 I want to commend you, because I know you were
18 part of a group of folks that actually lobbied I
19 believe it was Citibank to stop investing in --
20 you know, in these private prisons in other
21 states, and you were successful.
22 So -- but in this case, we're in a
23 state that does not have private prisons. We're
24 essentially telling New York State banks -- New
25 York State-chartered banks, state-chartered

1 banks, that they can't invest in them. But still
2 the Citibanks, Bank of Americas, the other
3 nationally chartered -- federally chartered banks
4 will still be able to invest in them.
5 So why not go the advocacy route,
6 since we're at the fifth time now and this bill
7 still hasn't moved in the other house?
8 SENATOR CLEARE: One of the banks
9 was Bank of America, and we were successful.
10 Why we are asking our banks not to
11 invest in these nonunion, unsafe, less regulated,
12 for-profit entities that create dangerous and
13 even deadly conditions for both incarcerated
14 persons as well as staff, and often breed
15 practices of corruption. And I don't think that
16 that's something that I think our banks should be
17 investing in, or any bank.
18 SENATOR BORRELLO: Madam President,

23 Madam President, yes.

1 SENATOR BORRELLO: So a lot of
2 banks in New York State, state-chartered banks,
3 federally chartered banks, private investment
4 firms, Wall Street firms, are right now investing
5 in so-called renewable energy projects where
6 we're actually paying for slave labor to mine
7 rare earth metals in places like the Congo, or
8 child labor.
9 So should we be asking them to
10 divest in those green-energy investments?
11 Because, you know, again, horrible conditions,
12 slave labor, child labor -- a lot of bad
13 conditions there. Should we be asking them to
14 divest in that?
15 SENATOR CLEARE: Through you,
16 Madam President, those sound like very terrible
17 things and I'm probably inclined to agree, but
18 that's not the bill that's before us right now.
19 SENATOR BORRELLO: Madam President,

1 SENATOR BORRELLO: So right now
2 essentially we're saying to our state-chartered
3 bank we're going to determine what kind of
4 investments you're allowed to make outside of
5 New York State. Why do we have -- why should we
6 have jurisdiction over that and tie the hands of
7 just state-chartered banks, which we're
8 continuing to lose? We have less and less and
9 less state-chartered banks, largely due to
10 restrictions like this.
11 Why would we want to do that when
12 it's really not going to have an impact outside
13 of state-chartered banks?
14 SENATOR CLEARE: I don't know if
15 this has an impact on the -- through you,
16 Madam President. I don't know if this has an
17 impact on the number of state-chartered banks. I
18 have not received any complaints from banks or
19 concerns from banks on this bill.
20 You know, I think this bill sets a
21 very clear moral and policy principle which
22 follows upon the fact that we already prohibit
23 the operation of private prisons in New York
24 State. But this bill just extends further the
25 principle by prohibiting state-chartered banking

1 institutions from providing financing or
2 investing in the stocks, securities or other
3 obligations of an entity that owns or operates a
4 private correctional facility.
5 SENATOR BORRELLO: Madam President,
6 on the bill.

10 Senator Cleare.
11 You know, we pass a lot of one-house
12 bills in this chamber. We're doing a lot in this
13 last few days of this last week. And I
14 understand that there's a value in sending some
15 kind of a message.
16 But the reality is Senator Cleare
17 and others have been more successful lobbying
18 banks, you know, through grassroots effort to
19 say: We don't want you investing in these
20 things. And that works much more effectively,
21 because at the end of the day there are more
22 federally chartered banks in New York State now
23 than state chartered banks.
24 And as we continue to lose those
25 state-chartered banks, these are the banks --

1 these are our local community banks, the people
2 that have local decision-making, the people that
3 ensure that maybe someone whose credit isn't so
4 great still gets that car loan, that a local
5 decision is made to ensure that that small
6 businesses can get that line of credit at a
7 reasonable rate.
8 Those are our state-chartered banks.
9 These investments, you may not like them, but at
10 the end of the day these investments are
11 something that are outside the scope, I believe,
12 of this chamber. Because if we're going to make
13 moral judgments on what they're investing in,
14 there's a whole slew of other things that we
15 should be saying you shouldn't be investing in.
16 I gave one example; there are
17 probably more. But at the end of the day, tying
18 the hands of the banks that are doing the most
19 for the people of New York State, the community
20 banks, is not the path. It's not the answer.
21 Because the simple solution for them is just no
22 longer be a state-chartered bank. Then we lose
23 any control over those things. We're losing them
24 more and more and more.
25 And that's the problem with this.

1 It is a rabbit hole that we should not be going
2 down, and I'll continue to be a no on this.

24 SENATOR CLEARE: New York has been
25 wise enough to ban the very existence of private

1 prisons in this state, and thus it is completely
2 logical to prohibit banks chartered by the very
3 same state from investing in an activity that we
4 have declared is not prohibited but morally
5 unpalatable.
6 As we stand here today, over
7 115,000 people in this country are in private
8 prisons. And the number being detained by ICE
9 only adds to this alarming number.
10 In my public service career, I have
11 helped numerous constituents, some of whom have
12 family members in private prisons, and the
13 experience was horrendous. It is often
14 impossible to make contact with your loved one,
15 set up visits, or perform any kind of wellness
16 check. There's no accountability, no care, no
17 safety, health.
18 Labor is an issue. I have literally
19 had constituents with family members from this
20 state who were incarcerated in private prisons in
21 another state who did not even have locks on
22 their cell at night. Staff is untrained.
23 Inmates have died unnecessarily, incarcerated
24 persons have died unnecessarily.
25 Given the fact that private prisons

1 are a moral, ethical and policy scourge filled
2 with lax safety standards for incarcerated
3 individuals and employees -- and in some cases
4 there are perverse initiatives to keep people
5 incarcerated longer, and long histories of
6 corruption with private prisons -- this bill
7 makes complete sense. New York banks should not
8 be allowed to profit from institutions that the
9 state itself deems impermissible to even exist.
10 Plain and simple.
11 Thank you, Madam President. I
12 proudly vote aye and encourage my colleagues to
13 do the same.
