        AN ACT to amend the penal law, in relation to  unlawful  concealment  of
          identity during a protest
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. The penal law is amended by adding a new section 240.11  to
     2  read as follows:
     3  § 240.11 Concealment of identity during a protest.
     4    A  person  is  guilty of concealment of identity during a protest when
     5  such person, while involved in a  lawful  assembly,  unlawful  assembly,
     6  protest,  or riot, wears a mask or facial covering whereby the person or
     7  the person's face is disguised so as to  conceal  the  identity  of  the
     8  wearer.  This section shall not apply to any person wearing:
     9    1. a mask, hood, or any device for protection from weather;
    10    2.  head coverings or veils in accordance with religious observance or
    11  customs;
    12    3. a mask for medical purposes; or
    13    4. a costume in any public parade, holiday, or exhibition of an educa-
    14  tional, religious, or historical character.
    15    Concealment of identity during a protest is a violation.
    16    § 2. This act shall take effect immediately.
