What's happening
This bill requires e-cigarette companies in New York to annually disclose their online advertising spending and details to the state.
Why it matters
Shines a light on digital marketing tactics. By requiring detailed, itemized disclosure of online advertising expenditures (including platforms, duration, and activities), the bill provides the state and public with a much clearer picture of how and where e-cigarette companies are targeting consumers online.
Facilitates accountability and potential regulation. The mandated annual reporting by the Department of Health to the governor and legislature could lead to more targeted rules and regulations—especially those aimed at reducing youth exposure to e-cigarette advertising.
Equips policymakers with data to protect children. By gathering and reporting specific information about where and how long ads are shown, the state will be better positioned to identify advertising practices that reach children and craft evidence-based policies to limit youth-targeted e-cigarette marketing.
