What's happening

This bill requires that incarcerated individuals who complete two uninterrupted years in a temporary release program must be granted parole.

Why it matters

  1. Creates a clear pathway to parole for incarcerated individuals. who demonstrate sustained responsibility and good behavior by completing two uninterrupted years in a temporary release program, potentially reducing uncertainty and arbitrary decision-making in parole outcomes.

  2. Could encourage greater participation in temporary release programs. (such as work release or educational release), which are designed to prepare individuals for reintegration and reduce recidivism by offering real-world experience and responsibility.

  3. Shifts the balance of discretion away from the parole board. for this subset of incarcerated individuals, making parole a mandatory outcome after meeting the specified criteria rather than leaving it to subjective assessment or changing standards.

  4. May result in earlier release for some incarcerated people. , leading to possible reductions in prison populations and associated costs, while also raising questions about public safety and support for those transitioning back into the community.

Who cares

  • Incarcerated individuals in temporary release programs

The bill would guarantee parole to those who successfully participate for two uninterrupted years immediately before their parole board appearance.

  • State Board of Parole

The board would have to grant parole to qualifying individuals notwithstanding the requirements of Executive Law section 259-i(2)(a).

  • Temporary release program administrators

Successful participation for two uninterrupted years immediately before a board appearance would become the basis for mandatory parole.
