What's happening

This bill requires individuals with suspended or revoked gun licenses to also surrender antique, black powder, and muzzle-loading firearms.

Why it matters

  1. Closes a loophole. by ensuring that individuals whose gun licenses are suspended or revoked cannot legally keep antique, black powder, or muzzle-loading firearms, which could previously be retained even after losing a modern firearms license.

  2. Expands the definition of "firearm" for surrender purposes. , meaning law enforcement can now confiscate a broader range of weapons from individuals deemed unfit to possess them, potentially reducing risks of harm or violence.

  3. Applies immediately to new suspensions and revocations. , so anyone who loses their license after the law takes effect must promptly surrender these additional categories of firearms, not just traditional guns.

  4. May affect collectors and hobbyists. , as these types of firearms are often owned for historical or recreational purposes, highlighting an increased emphasis on public safety over exemptions for older or non-standard weapons.

Who cares

  • Gun license holders facing suspension or revocation

The bill would require them to surrender any antique firearms, black powder rifles, black powder shotguns or muzzle-loading firearms they own or possess, in addition to weapons already covered by law.

  • Law enforcement agencies

They would receive the newly covered weapons surrendered following a license suspension or revocation.

  • Police officers and peace officers

The bill would authorize them, acting within their duties, to remove the newly covered weapons if their owners or possessors fail to surrender them.
