What's happening

This bill limits the THC potency of cannabis products in New York and makes exceeding these limits a class B misdemeanor.

Why it matters

  1. Establishes clear THC potency caps. The bill sets specific maximum THC concentrations—15% for cannabis flower and 25% for other products (including edibles, extracts, and medical cannabis)—which could significantly impact what products are available in the legal market.

  2. Aims to address public health and safety concerns. By capping THC levels, the legislation targets risks linked to high-potency cannabis, such as increased rates of dependency, mental health issues, and acute intoxication, especially among young or inexperienced users.

  3. Creates new legal risks for businesses and individuals. Cultivators, processors, distributors, and retailers who knowingly exceed these THC limits could face criminal charges (class B misdemeanor), potentially altering business practices, product offerings, and compliance costs in the cannabis industry.
