What's happening

This bill authorizes the Village of Bath in Steuben County to impose a local occupancy tax of up to 2% on hotel and similar accommodations until September 1, 2027.

Why it matters

  1. Provides a new revenue source for the Village of Bath. , allowing the local government to collect and use funds from the hotel occupancy tax for any lawful purpose, which could impact local services, infrastructure, or community programs.

  2. Shifts part of the tax burden to non-residents and visitors. , as the tax is imposed on those occupying hotels, motels, inns, and similar accommodations—potentially easing pressure on local property taxes while leveraging tourism or business travel.

  3. Includes clear guidelines and exemptions. , such as not taxing stays by government entities, certain nonprofits, or permanent residents (those staying 30+ consecutive days), and sets up a process for dispute resolution and refunds, which may affect local businesses’ administrative requirements and guests’ costs.

  4. Sets specific administrative and legal parameters. , including how taxes are collected, remitted, and reviewed, and limits each local law’s duration to three years (renewable), which adds transparency and opportunities for community oversight or adjustment in response to changing needs.

(11) If any provision of this section or the application thereof to any person or circumstance shall be held invalid, the remainder of this section and the application of such provision to other persons or circumstances shall not be affected thereby.
