P R O C E E D I N G SACTING PRESIDENT BAILEY:The Senate will come to order.
I ask everyone present to please rise and recite the Pledge of Allegiance.
(Whereupon, the assemblage recited the Pledge of Allegiance to the Flag.)
ACTING PRESIDENT BAILEY:As we celebrate our veterans today, I would respectfully like to ask the chamber to take a moment of silence for the "Lion of Lenox" -- a veteran, a servant, and a legend in the form of Charles B. Rangel.
A moment of silence, please.
(Whereupon, the assemblage respected a moment of silence.)
ACTING PRESIDENT BAILEY:Thank you.
Today's invocation will be by Mohammad Fayek Uddin, of the Islamic Center of Jackson Heights in Queens, New York.
IMAM UDDIN:Asalamu Alaikum.
(Response from assemblage.)
IMAM UDDIN:Good afternoon. Peace and blessings upon you all.
It is my honor and fortune that I am here today in this noble gathering. Before invocation, I would like to recite some verses of the Holy Book.
Bismillahir Rahmanir Raheem. In the name of Allah, most beneficent and merciful. {In Arabic.}
Indeed, Allah commands justice, grace, as well as generosity to close relatives. He forbids indecency, wickedness and aggression. He instructs you so perhaps you will be mindful. Honor Allah's covenant when you make a pledge, and do not break your oaths after confirming them, having made Allah your guarantor. Surely Allah knows all you do.
All the prophets are chosen and selected by God. They have said: We are blessed among the entire creation when the Almighty created us as His mightiest creation. Our duty and responsibility is very important because our reward and punishment is according to our actions.
We ask Almighty God for ability to do our best effort for good deeds and righteous actions in every aspect in our life.
We wish to God: O Almighty Allah, please empower our heart by the spiritual energy so that others can be beneficiaries and happy, exclusively for our blessed country, the United States of America, and our great State of New York.
And save the people of this country from all kinds of tribulations and trials.
And help those who work on behalf of our people of this country.
You are the most beneficent, merciful and benevolent. Ameen.
(Response of "Ameen.")
IMAM UDDIN:Thank you very much.

Senator Andrea Stewart-Cousins to be recognized.
SENATOR STEWART-COUSINS:Yes, thank you so much, Mr. President.
I thought it was fitting to introduce our newest Senator. So it's a proud moment for the people of the 22nd District for the State Senate, and certainly for our entire Democratic Majority.
It is my great pleasure to officially welcome our newest member, Senator Sam Sutton, to the chamber.
(Standing ovation.)
SENATOR STEWART-COUSINS:I'll just give you just the short bio. But he joins us with a deep and well-earned reputation as a community leader. He's spent decades fighting for his neighbors and communities in South Brooklyn.
Whether it's working to improve access to quality education, advocating for small businesses, standing up for working families, Sam brings a lifetime of service and deep understanding of what communities need to thrive.
Your record of advocacy, coalition building will be an invaluable asset to our chamber as we continue our work to advance a bold agenda focused on opportunity, equity and economic growth.
I know he'll be a tireless champion for his constituents and a strong partner in delivering real results for every corner of New York.
Again, welcome, and we look forward to a really wonderful career.
Thank you. Thank you.
(Applause.)
ACTING PRESIDENT BAILEY:Thank you, Madam Leader.
Senator Gianaris.
SENATOR GIANARIS:Mr. President, there's a privileged resolution at the desk, Resolution 1097.
Please take it up, read its title, and once again recognize Leader Stewart-Cousins.
ACTING PRESIDENT BAILEY:There is a privileged resolution at the desk.
The Secretary will read.
THE SECRETARY:Resolution 1097, by Senator Stewart-Cousins, honoring the distinguished veterans from the State of New York upon the occasion of their induction into the New York State Senate 2025 Veterans Hall of Fame.
ACTING PRESIDENT BAILEY:Majority Leader Andrea Stewart-Cousins on the resolution.
SENATOR STEWART-COUSINS:Thank you, Mr. President.
I rise and this time I want to make sure that I thank our chair of Veterans and Homeland Security, Senator Scarcella-Spanton, as well as the ranker, Senator Ashby, as well as all of our colleagues, but certainly Senator Scarcella-Spanton for helping to put together our 20th recognition of veterans by this chamber.
It is extraordinary when we think that 20 years has passed since we began this recognition. And something that Leader Ortt said this morning, I wanted to make sure that we in this chamber understood. He thanked me for continuing the tradition of honoring the veterans that had been started before we were a majority here on this side.
Had I continued that tradition, we would only have honored Democratic military people, because the original setup, basically the majority honored their veterans.
I remember getting here in 2007 with a veteran that I wanted to honor, but I couldn't, because we weren't in the majority. And I had to go through my Republican mayor to beg to have this person included.
It was during that time that I had a Republican Senator, Tom Morahan, stand up and say he agreed that we have to honor all of our veterans, because service transcends political parties. And when we took the majority in 2009, that's exactly what we did.
So the tradition of service is honored in every quarter, in every corner of our state. And when I looked again at the array of amazing veterans -- their heroism, their bravery, their courage, from World War II, Korean War, Vietnam, Afghanistan, as Senator Ortt has served, and so many others -- and of course, you know, I'm not talking of all of the different deployments and so on -- we have to always recognize that that service which allows us to be in these chambers has to be honored.
And the other thing I thought about as I looked at this amazing group of people from all over the state, all different backgrounds and ethnicities, the conversation about DEI and the military.
I've stood on this floor so many times talking about my father, who served in a segregated Army, who -- Purple Heart, Bronze Star -- came back to a segregated country, did not get the GI Bill or any of its benefits.
Just last week we were celebrating the Borinqueneers -- thank you, Senator Fernandez and Senator Sepúlveda, for that -- Puerto Ricans who had been deployed, starting in the Korean War and going forward, who to this day get 60 percent of their benefits.
I think about my brother, the Vietnam War veteran, who came back and like all the veterans at that time, because the war was extremely unpopular, they were denigrated.
And my own honoree today, Randy Jurgensen, who many of you heard his story of his accomplishments, he begged for us to remember the Korean War, which is why we celebrate it, because it's so-called the "Forgotten War." Think about that: Diversity, equity, inclusion.
My dad was not included. The equity for the Borinqueneers, for the Vietnam vets, was not there. The diversity of every single one of us and the people we love and the people we acknowledge who are willing to put their lives on the line and die for this country. Diversity, equity, inclusion. You have people who are willing to D-I-E, die, so that we can be here.
So I am so proud to be able to, yes, take a tradition, make it more inclusive because of the diversity and because we need to have the equity.
And as we sit here in this chamber today passing legislation that builds on what we've done in the past for our veterans, we will continue, I hope, collectively to make sure that even on a national level they hear that we must honor those who are willing to, yes, D-I-E for our freedom.
Thank you, Mr. President.
(Applause.)
ACTING PRESIDENT BAILEY:Thank you, Madam Leader.
Senator Scarcella-Spanton on the resolution.
SENATOR SCARCELLA-SPANTON:Thank you, Mr. President.
And thank you, Madam Leader, for your powerful words. I can sit here and say that I am truly honored to be part of this body under your leadership, because I see how much you care about veterans and their families. So thank you so much.
I'm so happy to be here today as we recognize the 2025 Class of the New York State Senate Veterans Hall of Fame.
As the chair of the Senate Committee on Veterans, Homeland Security and Military Affairs, this is truly one of the most meaningful moments of session. And I mean that. I really love to hear everybody's backstory of every veteran who comes up.
Year after year we all have the honor of learning about the extraordinary lives of these veterans from every corner of New York, stories of their courage, resilience and service.
Today I am proud to honor my third inductee into the Veterans Hall of Fame, exceptional Staten Islander and American hero Louis Lupinacci, also formerly known as Uncle Louie on Staten Island.
On December 23, 1942, Louie enlisted in the United States Army and trained at Fort Sheridan as a machine gunner. Just two years later, he landed in the first wave at Easy Red Beach on D-Day. Louie fought valiantly through the beaches of Normandy and continued his service across Belgium, Holland, Scotland, England and Germany, helping to secure and stabilize regions critical to defending democracy and the world.
When he returned home from war, he didn't stop serving his country. As he worked through his own transition back to civilian life, he joined the 52-20 Club, a program that helped other veterans transition as well.
Over the course of his life, Louie Lupinacci received numerous honors, including the Army Good Conduct Medal, the World War II Victory Medal, the European African Middle Eastern Campaign Medal, the Army of Occupation Medal, and the D-Day Commemorative Medal.
And this past September, Louie reached an extraordinary milestone: His 100th birthday. And he actually was up here with us today. I have to brag about Louie. Louie still drives. He said that the key to life is making sure you drink wine with peaches in it. I felt like I should pass that information -- red wine with peaches in it. I felt like I should pass that information along to everybody.
(Laughter.)
SENATOR SCARCELLA-SPANTON:But in celebration, October 9th has officially been declared Louis "Louie" Lupinacci Day on Staten Island by our borough president.
And I was honored to be able to take part in his 100th birthday, because what I've gotten to see from Uncle Louie is really how to live life and how to enjoy life. He had so many people surrounding him. I only met him at his birthday party, so I'm looking for someone who you would think would look like a 100-year-old, which I did not find. He came running down the stairs to greet me and say hello as he got his proclamation. And he ate it up, he really did.
So it was truly an honor. He was up here with his family today. It was an honor to have him with us. And it's an honor to be able to serve in this committee to get stuff done for our veterans, for their families, and for people like Louie.
So thank you. I proudly vote aye.
ACTING PRESIDENT BAILEY:Thank you, Senator.
(Applause from gallery.)
ACTING PRESIDENT BAILEY:Senator Ortt on the resolution.
SENATOR ORTT:Thank you, Mr. President.
I rise to speak on the resolution. I want to thank everyone who helps make this event what it is.
I think of Colonel Bill Larkin, who I know, you know, lived for these days, kind of like West Point Day, Veterans Hall of Fame Day. But the truth is I think we all look forward to this day. I think we all look forward to putting forth -- I said this morning, 300,000 constituents we all have, roughly, and we are able to pick out one person a year who has served and almost universally who has continued to serve our community. I mean, you think about all the people we come into contact with, how remarkable these individuals are each year that we're able to put forward.
I consider myself the lucky one, not them. I'm lucky to get to know many of these folks and to be able to recognize their service to our country and our community.
And I'll just say, you know, lookit, we're in a moment where -- a chamber rife with political disagreement, different ideas about how the country should go forward. We recognized I guess it was 50 years since -- it was the end of the Vietnam War, 50 years since the end of probably the most divisive conflict, at least socially, politically, in American history, certainly modern American history.
And the lesson out of Vietnam -- there's a lot of lessons, a lot of lessons militarily. But the lesson I think culturally, politically, is to never mistake the soldier for the policymaker. You don't like the policy? You don't like conflict? I haven't met anybody who does. But don't mistake the 19-year-old soldier, Marine, airman, sailor -- because that's what happened. They were the -- I don't think anyone -- I don't remember anyone spitting on Lyndon Johnson or on Richard Nixon. But they spit on the Marine and the Army soldier and the Navy veteran who came home from Vietnam. That's who took the brunt.
And the lesson we take out of that 50 years later is we don't make that mistake today with our veterans. They come back and we say thank you and we give them all kinds of, you know, discounts and, you know, a free car wash and 25 percent off at a restaurant. And like I said, I'll take it. I didn't do it for that reason, but I'll take it.
And I know the veterans in here -- Senator Chan, Senator Stec, Senator Walczyk, Senator Ashby, Senator Sanders -- we all take it, but that's not why we did it. And that's not why the 63 inductees into the Veterans Hall of Fame did it. They did it because they believe in something bigger than ourselves. They believe that they are a continuation, they're the vanguard, they're the defenders of the great experiment that we call American democracy and the United States of America.
And it is actually, it is actually our unity -- see, in the military it's about unity. It's one uniform. It's one mission. It's one enemy. And that's how you win wars to protect freedom. And that's the only way you win wars to protect freedom and protect this nation.
And that's what each one of those 63 -- yes, a broad tapestry of our great state and our great republic. But I can assure you indistinguishable in formation, indistinguishable on the field of battle. And indistinguishable when you look at the rows of crosses at Arlington National Cemetery yesterday on Memorial Day.
It is exactly our unity, especially when we talk about veterans and the military, that separates our nation and why we are victorious and have been victorious against a multitude of enemies over the years.
So Mr. President, I rise to support this resolution, and thank you for your indulgence.
ACTING PRESIDENT BAILEY:Thank you, Senator Ortt.
Senator Ashby on the resolution.
SENATOR ASHBY:Thank you, Mr. President.
I want to thank our chairwoman for the wonderful job that she does; our Majority Leader; our leader, Senator Ortt, for bringing this resolution to the floor.
And to you, Mr. President, earlier remarking on Congressman Rangel -- Bronze Star with Valor, Purple Heart. That's incredible. And a life of service.
And to all our veterans and their families who are joining us in the chamber today, you are what inspire us to do a better job. Your continued service, your dedication, day in and day out. Because I don't think many people realize the sacrifices that you and your family have made when you took that oath.
We're not just talking about missing milestones in our children's lives. We're leading up to that time and that milestone, not just first words, but the time leading up to those first words, the time leading up to those first steps. That time with your family that you can never get back. You can't get it back. It's gone. For us to have what we have here today, the opportunity to do better, the opportunity to inspire.
And when I think about what we have made, the success stories that we have had in the last few years -- elevating our Division of Veteran Services to a department. And where it is now, it ranks among the lowest-funded departments in our state. The Office of Cannabis Management -- two times the amount of funding, three times the amount of staff.
We just celebrated Memorial Day yesterday. Think about the sacrifices that were made and are going to be made by so many more veterans.
Keeping that in mind, I know everyone in this chamber knows we can do better.
Thank you, Mr. President.
ACTING PRESIDENT BAILEY:Thank you, Senator Ashby.
The question is on the resolution. All those in favor please signify by saying aye.
(Response of "Aye.")
ACTING PRESIDENT BAILEY:Opposed, nay.
(No response.)
ACTING PRESIDENT BAILEY:The resolution is adopted.
Senator Gianaris.
SENATOR GIANARIS:Mr. President, Leader Stewart-Cousins would like to open that resolution for cosponsorship.
ACTING PRESIDENT BAILEY:The resolution is open for cosponsorship. Should you choose not to be a cosponsor, please notify the desk.
Apologies. To our heroic, brave, selfless, warrior, incredible veteran guests, I welcome you on behalf of Majority Leader Stewart-Cousins and the New York State Senate. We extend to you every privilege and courtesy of this house and anywhere else we can.
Please rise and be recognized.
(Extended standing ovation.)
ACTING PRESIDENT BAILEY:We should probably vote for that one again, Senator Gianaris.
SENATOR GIANARIS:Let's take up the reading of the calendar, please.
ACTING PRESIDENT BAILEY:The Secretary will read.
THE SECRETARY:Calendar Number 248, Senate Print Number 2364, by Senator Scarcella-Spanton, an act to amend the State Law.
ACTING PRESIDENT BAILEY:Read the last section.
THE SECRETARY:Section 2. This act shall take effect immediately.
ACTING PRESIDENT BAILEY:Call the roll.
(The Secretary called the roll.)
ACTING PRESIDENT BAILEY:Announce the results.
THE SECRETARY:Ayes, 59.
ACTING PRESIDENT BAILEY:The bill is passed.
THE SECRETARY:Calendar Number 263, Senate Print 1183, by Senator Addabbo, an act to amend the Real Property Tax Law.
ACTING PRESIDENT BAILEY:Read the last section.
THE SECRETARY:Section 2. This act shall take effect immediately.
ACTING PRESIDENT BAILEY:Call the roll.
(The Secretary called the roll.)
ACTING PRESIDENT BAILEY:Senator Scarcella-Spanton to explain her vote.
SENATOR SCARCELLA-SPANTON:Thank you, Mr. President.
And thank you, Senator Addabbo. Year after year we pass this very important bill. Just a few hours ago we all stood together to honor our veterans for the Hall of Fame ceremony. And almost every single veteran mentioned this bill by Senator Addabbo to me.
This bill would allow veterans who are 100 percent service-disabled to receive 100 percent off of their property taxes. This is something that New Jersey is already doing.
So again, I remind you, if we want our veterans and our military families to lay their roots here and stay here in New York, this is an incredibly important bill.
I know that every single person in this chamber supports this bill because every single year we pass it and every single year it passes unanimously. But I want to see it happen on the other side. So let's cross our fingers and hope it gets signed into law.
I proudly vote aye, and thank you, Senator Addabbo.
ACTING PRESIDENT BAILEY:Senator Scarcella-Spanton to be recorded in the affirmative.
Senator Griffo to explain his vote.
SENATOR GRIFFO:Thank you, Mr. President.
Thank you, Senator Addabbo. And Senator Scarcella-Spanton is right. Yesterday we paid homage to all of our departed, and we continue to respect and recognize those who have served and continue to serve us. But what this bill truly does is demonstrates through action, more than words, genuine concern and commitment to these disabled veterans.
And yes, the Assembly needs to hear this, understand it, appreciate this, and follow in the action being taken here in the Senate today.
I vote yes.
ACTING PRESIDENT BAILEY:Senator Griffo to be recorded in the affirmative.
Announce the results.
THE SECRETARY:Ayes, 59.
ACTING PRESIDENT BAILEY:The bill is passed.

THE SECRETARY:Section 2. This act shall take effect immediately.
ACTING PRESIDENT BAILEY:Call the roll.
(The Secretary called the roll.)
ACTING PRESIDENT BAILEY:Senator Ramos to explain her vote.
SENATOR RAMOS:Thank you, Mr. President.
Today we're voting on a land alienation bill that on its face does not authorize a casino, and yet we all know what this is about. This is about clearing a key procedural hurdle for a development that has deeply divided my community.
I'm voting no today. This decision has not been easy, and I didn't arrive to it quickly. Over the past year I've done what I believe every elected official should do when faced with a question of this magnitude. I held three public town halls, I released a districtwide poll, I created an online survey, and I met with dozens of constituents, both for and against, who took the time to speak with me about what this project means for our future.
That process reaffirmed something I already knew: My community's paying attention. We want investment. We want good jobs. We want green space, housing, and real opportunities for our children.
But after decades of public neglect, it feels like the first serious proposal on the table is a casino. That is not the kind of development that my community deserves. Casinos may bring lights, but they also bring shadows. They extract wealth from working-class communities, they prey on addiction and often displace the very people they claim to uplift.
While casinos generate revenue for operators, the neighborhoods around them often suffer from increased economic instability, public health concerns, and a rise in problem gambling.
I've also looked carefully at who is behind this proposal. Mr. Steve Cohen is not just a wealthy investor, he's a figure with a long and well-documented history of regulatory violations. His former hedge fund paid the largest insider trading fine in U.S. history. And that matters. Because when someone with a record of skirting the rules asks us to clear the path for a project with immense financial upside, we have to ask: Who stands to win? And who's being asked to take the risk?
This is not about a building or a parcel of parkland. It's about power. It's about whether communities like mine are treated as partners or as pawns. And I have to say that what we've witnessed over the past two years has raised serious concerns in my community. We've seen a well-financed campaign that has stacked community boards, hired consultants from within the neighborhood, and shaped a narrative that doesn't reflect the full range of views I've heard in my district.
That kind of process isn't democratic. It's engineered. But even with all that, I want to acknowledge the people in my district who do support this plan. Many are acting in good faith. They see a chance to finally get something, anything, in return for years of disinvestment.
I don't question their motives. What I do question is the deal we're being offered. A casino is not an answer to structural inequality. It's not a pathway to equity. And it's not the future I want to build for Corona, East Elmhurst, or any part of Queens.
And I would be remiss not to express some disappointment that many who call themselves champions for working people have remained silent.
When billions are at stake and public trust is on the line, silence is not neutrality. It's complicity. Our communities deserve better than a calculated indifference. They deserve courage.
This vote today may not be the final say, but it's an open door. And I will not be the one to open it.
So I cast my vote today not in opposition to my neighbors, but in defense of a vision of economic development that is dignified, sustainable, and rooted in the needs of working people, not in the whims of a billionaire.
Thank you.
ACTING PRESIDENT BAILEY:Senator Ramos to be recorded in the negative.
Senator Krueger to explain her vote.
SENATOR KRUEGER:Thank you, Mr. President.
I also rise to explain that I'll be voting no on this bill. I don't think that comes as much of a surprise to the people in this chamber.
I don't like gambling. I particularly don't like government-cosponsored gambling. And with this bill, while it is true that some people say it doesn't have anything to do with the casino, in the absence of this bill this couldn't possibly be a casino here.
And so to use state land or city land and resources to build a casino isn't economic development. I want to repeat what I just heard Senator Ramos say. Just because you spend money doesn't mean it's economic development. Economic development is something that creates new economic activity and opportunity. And the truth is with gambling, the house always wins. And so there's really only one winner, no matter how you look at it: Whoever owns the casino or the gambling site.
The research shows the majority of money made in each and every casino opened in this country is made from neighborhood people who then go and spend their disposable income in the casino, meaning they're not spending it on other things.
Sometimes they're becoming addicted. But even if they're not officially addicted, their money's going to the casino, not the education of their children or their rent or their food or other social activities, or even investment in their own entrepreneurial opportunities.
And so it's a bad deal. Not this one more or less than any other. I'll also be against any casinos in my own borough. There are three or four still trying. And I would be against the casinos wherever they are because it's not a good use of the people's money. And frankly we keep thinking it's some kind of silver bullet for our tax revenue, but that never proves to be true either.
So I'll be no, Mr. President.
Thank you.
