BILL NUMBER:A11046

Title of bill

An act relating to the process for selection of a video lottery gaming operator at Aqueduct Raceway

Purpose

To expedite the selection of a video lottery terminal gaming operator for the Aqueduct Raceway in Queens in a mariner that is trans- parent and effective.

Summary of provisions

This bill creates an expedited, transparent, non-political process for selection of a video lottery terminal gaming operator for development and operation of video lottery terminal gaming facility at the Aqueduct Raceway in Queens. It deems the time for submission of proposals still open, and all submissions still viable pursuant to the statement and decision of the Governor as publicly announced on March 11, 2010. It then creates a process for selection of a new vendor, under the following timetable:

ACTION DATE Provision to allow submitting 10 days after effective date or amending proposals of this act

State Comptroller to recommend 10 days after effective date one of the big four accounting of this act firms as reviewer

Selection of a third party 20 days after the effective date reviewer by Governor, Speaker, of this act and Temporary President of the Senate

Transmittal of proposals to 25 days after the effective date reviewer, and revealing of this act of the names and business address of potential vendors

Recommendation by Reviewer, 40 days after the effective date and revealing of name and of this act reasons for recommendation

Public hearing 10 days after recommendation

Selection of vendor 15 days after the public hearing

Minimum bid Minimum cash component of any bid shall be $300 million, provided that nothing shall prevent a potential vendor from a larger cash component

Justification

The selection process for naming an operator has taken several years and two Governors with limited progress. The State is

facing a $9 billion SFY 2010-2011 current services deficit. Resolving the Aqueduct issue would bring much needed cash and finally get the project started. This would create hundreds of needed jobs.
