Title of bill

An act relating to the process for selection of a video lottery gaming operator at Aqueduct Raceway

Purpose

To expedite the selection of a video lottery terminal gaming operator for the Aqueduct Raceway in Queens in a manner that is transparent and effective.

Summary of provisions

This bill creates an expedited, transparent, non political process for selection of a video lottery gaming operator for development and operation of a video lottery terminal gaming facility at the Aqueduct Raceway in Queens. It deems the time for submission of proposals still open, and all submissions still viable pursuant to the statement and decision of the Governor as publicly announced on March 11, 2010. It then creates a process for selection of a new vendor, under the following timetable:

ACTION DATE Provision to allow submitting 10 days after effective or amending of proposals date of the act.

State Comptroller to Recommend 10 days after effective one of the big four accounting date of the act. firms as reviewer.

Selection of third party reviewer 20 days after effective by Governor, Speaker and Temporary date of the act. President of the Senate.

Transmittal of proposals to reviewer, 25 days after effective and revealing of the names & business date of the act. address of the potential vendors.

Recommendation by Reviewer, and 40 days after effective revealing of name and reasons for date of the act. recommendation.

Public hearing. 10 days after recommendation.

Selection of vendor. 15 days after the public hearing.

Minimum bid. Minimum cash component of any bid shall be $300 million, provided that nothing shall prevent a potential vendor from a larger cash component.

Justification

The selection process for naming an operator has taken several years and two Governors with limited progress. The State is facing a $9 billion SFY 2010-11 current services deficit. Resolving the Aqueduct issue would bring in much needed cash and finally getting the project started. This would create hundreds of much needed jobs.
