BILL NUMBER:A7092A
Title of bill
An act to amend the town law and the public officers law, in relation to the position of building inspector/code enforcement in the town of Windsor
Purpose or general idea of bill
Provides that the person holding the title of building inspector/code enforcement in the town of Windsor, county of Broome need not be an elector of such town.
Summary of specific provisions
Section 1. Section 23 of the town law is amended by adding a new subdivision 23 to read as follows:
23. Notwithstanding the provisions of subdivision one of this section, in the town of Windsor, in the county of Broome, the person performing the functions of the town building inspector and code enforcement officer need not be an elector of such town. Provided, however, the person performing the functions of town building inspector in any other town shall be an elector of such town, unless otherwise provided by an act of the state legislature.
§ 2. Section 3 of the public officers law is amended by adding a new subdivision 56 to read as follows:
56. In the town of Windsor, in the county of Broome, the provisions of this section requiring a person to be a resident of the political subdivision or municipal corporation of the state for which he or she shall be chosen or within his or her official functions are required to be exercised, shall not prevent a person from holding the office of town building inspector and code enforcement officer provided that such person resides in the county in which such town is located or an adjoining county within the state of New York. Provided, however, the person performing the functions of town building inspector in any other town shall be an elector of such town, unless otherwise provided by an act of the state legislature.
§ 3. This act shall take effect immediately.
Existing law
Provides that the building inspector/code enforcement is required to reside within the town of Windsor.
Justification
Currently, the position of building inspector/code enforcement for the town of Windsor is one that requires the holder of that position must be a resident of the town of Windsor. The requirement of Section 23 of the Town Law makes it very difficult for the small town such as Windsor to hire an individual with skills, knowledge, experience and who meets the requirements if they are only allowed to look within their town. This bill would allow the town to look in a broader spectrum for the right person for the job.
