Sponsor's memo

Title of bill

An act to amend the town law and the public officers law, in relation to the position of building inspector/code enforcement in the town of Windsor

Purpose or general idea of bill

Provides that the building inspector/code enforcement is not required to reside within the town of Windsor.

Summary of specific provisions

Section 1. Amends the Town Law to allow the building inspector/code enforcement officer to reside outside of the Town of Windsor.

Section 2. Amends the Public Officers Law to allow the building inspector/code enforcement officer to reside outside of the Town of Windsor.

Section 3. Establishes the effective date.

Existing law

Provides that the building inspector/code enforcement is required to reside within the town of Windsor.

Justification

Currently, the position of building inspector/code enforcement for the town of Windsor is one that requires the holder of that position must be a resident of the town of Windsor. The requirement of Section 23 of the Town Law makes it very difficult for the small town such as Windsor to hire an individual with skills; knowledge, experience and who meets the requirements if they are only allowed to look within their town. This bill would allow the town to look in a broader spectrum for the right person for the job.

Prior legislative history
