BILL NUMBER:A7350
Title of bill
An act to amend the tax law, in relation to authorizing the city of Peekskill to impose hotel or motel taxes within such city
Purpose or general idea of bill
An act to amend the Tax Law imposing a hotel or motel tax in the City of Peekskill.
Summary of specific provisions
The Tax Law is amended by adding a new Section 1206-aa. The new section authorizes and empowers the City of Peekskill to adopt and amend local laws imposing a tax upon peoples' occupying hotel and motel rooms in the City of Peekskill. The rates of such a tax shall not exceed three percent (3%) of the per diem rental rate for each room, and that it is not applicable to a permanent resi- dent of a hotel or motel. The term hotel or motel shall mean and include any facility consisting of rentable units and providing lodging on an overnight basis and shall include those facilities designated and commonly known as bed and breakfast and tourist facilities. A permanent resident shall mean a person occupying any room or rooms in a hotel or motel for at least ninety (90) consecutive days.
The tax may be collected and administered by the chief fiscal officer of the City of Peekskill and in the same manner as other taxes are now collected and administered. The tax shall be paid by the person occupy- ing or renting the room to the owner of the hotel or motel room. The tax is considered as part of the rent or charge and payable at the same time of the rent or change. Local laws may provide for the filing of returns and the payment of the tax on a monthly basis or on the basis of any longer or shorter period of time.
Justification
Currently, the City of Peekskill does not impose a tax on visitors who stay in hotels or motels within the City. The absence of such a tax means that Peekskill residents are paying for the resources and services used by those visitors through their local taxes. The City of Peekskill has determined that the imposition of a motel/hotel tax is a fairer way to spread the costs of municipal services amongst property owners and visitors.
