Title of bill

An act to amend the insurance law, in relation to rules relating to the processing of health claims and overpayments to physicians and other health care providers

Purpose

To set forth a number of reforms to the manner by which health insurance companies process claims for health insurance benefits from health care providers.

Summary of provisions

This bill amends section 3224-b(b) of the Insurance Law by expanding the existing statute to cover all health care providers.

Existing law

Currently, section 3224-b(b) of the Insurance Law applies only to physicians and provides that when insurance overpayments occur, a health plan shall provide thirty days written notice before seeking recovery of the overpayment of claims, and a health plan shall not initiate overpayment recovery efforts more than twenty-four months after the original payment was received. This bill would make these provisions applicable to other health care providers.

Justification

This legislation seeks to address some of the difficulties faced by health care providers when dealing with health insurance plans. In 2006, legislation was signed into law as Chapter 551 that amended the rules relating to the processing of health claims and overpayments to physicians. This legislation would expand the 2006 law to make the rules relating to the processing of health claims and overpayments apply to all health care providers. This legislation would establish fair, uniform and consistent procedures for the processing of overpayment recovery claims for all health care providers.
