Title of bill
An act to amend the election law, in relation to absentee voting for primary care givers
Purpose
This bill would allow primary care givers of persons who are suffering from a physical disability or illness to vote by absentee ballot.
Summary of provisions
Section 1 of the bill amends Election Law § 8-400 (1) (c) to allow primary care givers of persons who are suffering from a physical disability or illness to vote by absentee ballot.
Section 2 of the bill amends Election Law § 8-400 (3) (c) (iii) to modify the absentee ballot application to reflect the additional category of persons who may vote by absentee ballot.
Section 3 of the bill provides the effective date.
Existing law
Currently, the law permits an individual to apply for an absentee ballot if he or she is unable to appear personally at the polling place in which he or she is a qualified voter because of illness or physical disability, whether permanent or temporary or because he or she will be or is a patient in a hospital.
Statement in support
Voting is the most important right that the citizens of a democracy possess. Unfortunately, some people who desire to vote are unable to do so because they cannot appear at their polling site because they are the primary care givers of one or more individuals who are ill or physically disabled. This bill will allow these care givers to apply for an absentee ballot so that they can provide the care needed and still exercise their right to vote.
Budget implications
None to the state.
Effective date
This act would take effect immediately.
