Today, with the adoption of this 17 resolution, we'll be reinstating the exemption 18 for our firefighters to operate our large 19 heavy equipment throughout the State of 20 New York as it relates to fire districts. 21 This is something that has enjoyed 22 broad support, geographically and also within 23 this chamber and the chamber in the Assembly. 24 It's one of these instances where it crosses
Candyco Transcription Service, Inc.
(518) 371-8910 1 party lines with broad bipartisan support, not 2 just on the adoption of the measure but also 3 on the cosponsorship. 4 So I'm very, very pleased to have 5 worked with our colleagues here in the Senate, 6 along with a number of, let's say, interested 7 parties throughout this state, from northern 8 portions to the City of New York to Long 9 Island, where in one voice we are saying thank 10 you to our firefighters and giving back to 11 them something that they had enjoyed for 12 decades, and that is this particular 13 exemption. 14 What's most, let's say, noteworthy 15 and timely is the fact that by passing this 16 today, and with unusual speed, it's my 17 understanding that the Governor will sign this 18 into law so that all the fire departments 19 throughout this state will be able to 20 participate fully in this coming weekend's 21 Memorial Day parades, which we know is part 22 and parcel of the culture of so many 23 communities within this state, as it is within 24 our country.
Candyco Transcription Service, Inc.
(518) 371-8910 1 So it's a very important day, if 2 you will, for our firefighters, both paid and 3 volunteers, and it's a way that we can say 4 thank you to them. And as much as this may 5 have been and should have been passed some 6 time ago, we finally arrived at a point where 7 we will adopt this prior to Memorial Day 8 services and parades. 9 So I want to thank my colleagues 10 for their strong support, and I particularly 11 want to say thank you to Senator Bonacic, who 12 during the budget proceedings the other month, 13 where there were some harsh words expressed in 14 a variety of ways, but he had reached out to 15 say and in particular to thank this Senator 16 for putting this bill forward. 17 We hope that this can be a 18 confidence-building measure so that there are 19 other pieces of legislation that we can do 20 together as well. 21 And I also want to thank our 22 Majority Leader, as well as our conference, in 23 moving forward and being supportive of this 24 proposal as well.
Candyco Transcription Service, Inc.
(518) 371-8910 1 Thank you, Mr. President. 2 ACTING PRESIDENT VALESKY: 3 Senator Foley to be recorded in the 4 affirmative. 5 Senator Robach, to explain his 6 vote. 7 SENATOR ROBACH: Yes, 8 Mr. President. 9 I am very happy we're doing this 10 bill today. This is important. And I want to 11 thank the sponsor. 12 There were several bills in there, 13 and the original bill getting amended to be 14 more inclusive to protect, in every instance, 15 firefighters from doing what they've been 16 doing for a number of years. 17 And this is one of those examples 18 where this level of government, us in this 19 chamber and across the hall, can say to some 20 degree we cleaned up or fixed what was a very, 21 very bad interpretation. 22 For those of you that are involved 23 in fire service, for a number of years the 24 same condition existed -- I'm not sure if it's
Candyco Transcription Service, Inc.
(518) 371-8910 1 the federal government or somebody at our end 2 bureaucratically, but for the first time 3 decided driving to an event, a fire event or 4 emergency, would only constitute getting there 5 to put out the fire but not driving the 6 apparatus back to the firehouse. 7 So in the interim, what I had been 8 instructing people to do was start a fire in 9 the wastebasket, call it then, then you'd be 10 able to legally drive your fire truck back to 11 the firehouse, thanks to bad bureaucratic 12 decision-making. 13 But this bill, on a serious note, 14 will really clean that up and even go above 15 and beyond that, for training and other events 16 that volunteer firefighters and others do on a 17 regular basis that not only makes our 18 community safer but enhances it. 19 I'm very happy to get this done and 20 join everyone and say a job well done. 21 ACTING PRESIDENT VALESKY: 22 Senator Robach to be recorded in the 23 affirmative. 24 Senator Craig Johnson, to explain
Candyco Transcription Service, Inc.
(518) 371-8910 1 his vote. 2 SENATOR CRAIG JOHNSON: Thank 3 you, Mr. President. 4 I rise to support this measure and 5 truly to commend Senator Foley, who picked up 6 this measure and worked through some very 7 complex issues, had a few roadblocks, stuck 8 with it, was persistent, and today we can 9 proudly vote in the affirmative to fix a 10 problem that never should have been a problem. 11 And so I want to thank you, Senator 12 Foley, for the firefighters who are in the 13 7th Senatorial District, the men and women who 14 reached out to me and said this was a big 15 problem, not just about the parades that are 16 going to happen over the weekend and July 4th, 17 but also the safety issues that it created, 18 the lack of foresight by those who tried to 19 interpret the rule in an inappropriate and 20 incorrect way. 21 So congratulations, Senator Foley. 22 I'm happy that the Governor is going to sign 23 this quickly and it will become law. I'll be 24 voting yes.

(518) 371-8910 1 Thank you, Mr. President. 2 ACTING PRESIDENT VALESKY: 3 Senator Craig Johnson to be recorded in the 4 affirmative. 5 Senator Bonacic, to explain his 6 vote. 7 SENATOR BONACIC: Thank you, 8 Mr. President. 9 Our volunteer firefighters are the 10 backbone of our upstate communities. And I 11 just wanted to thank Senator Foley; Senator 12 Carl Kruger, who said that he would address 13 this during the budget process; Senator 14 Schneiderman for expediting it through the 15 Codes Committee. 16 Today is an example of how, with 17 bipartisan cooperation, we can get things done 18 quickly and do something in a very beneficial 19 and constructive manner that helps our heroes. 20 Thank you to all of you. I vote 21 yes. 22 ACTING PRESIDENT VALESKY: 23 Senator Bonacic to be recorded in the 24 affirmative.
Candyco Transcription Service, Inc.
(518) 371-8910 1 Senator Stachowski, to explain his 2 vote. 3 SENATOR STACHOWSKI: Yes, 4 Mr. President. I too would like to stand and 5 commend Senator Foley on his work on this bill 6 and jumping through all the hoops that were 7 put in front of him and to have worked with 8 everybody else to help our volunteer firemen. 9 Because we all work with them 10 exclusively in our districts. They brought a 11 problem to us, everybody jumped in to be 12 supportive. Senator Foley has the bill; it's 13 very important. 14 And hopefully the Governor or his 15 people are listening and he'll sign the bill 16 today or tomorrow, because there's a lot of 17 parades this weekend for Memorial Day, and a 18 lot of volunteer fire companies have already 19 alerted the parade people that they won't be 20 participating with their vehicles because 21 they're not allowed to drive them in parades 22 if they don't have a CDL-licensed driver 23 available on the day of the parade. 24 So it would be a shame that all
Candyco Transcription Service, Inc.
(518) 371-8910 1 those little kids lining up as part of the 2 Memorial Day ceremony for those communities 3 that have parades won't get to see the fire 4 trucks that they grow accustomed to seeing and 5 look forward to seeing because we didn't get 6 the bill signed in time. And so there is a 7 sense of urgency. 8 I commend the sponsors in each 9 house for their rapid movement on this, and 10 hopefully the second floor will sign it in a 11 rapid fashion also and we can alleviate this 12 problem in time to help with the participation 13 as well as all the day-to-day problems that 14 this situation had brought up for our 15 volunteer firemen. 16 Thank you. 17 ACTING PRESIDENT VALESKY: 18 Senator Stachowski to be recorded in the 19 affirmative. 20 Senator Ranzenhofer, to explain his 21 vote. 22 SENATOR RANZENHOFER: Thank you, 23 Mr. President. 24 I also rise to support this very
Candyco Transcription Service, Inc.
(518) 371-8910 1 common-sense legislation. This is really 2 government getting out of the way and letting 3 volunteer firefighters do their job. 4 With the ranks of volunteer 5 firefighters down, we need to do everything 6 that we can to encourage recruitment and 7 retention of volunteers. And what they do in 8 our communities in terms of the number of 9 hours that they have to put in, what they do 10 to save our homes, our businesses and our 11 lives, really goes -- you can't say enough 12 about that. 13 So this is a very strong piece of 14 legislation, a common-sense piece of 15 legislation which should be supported, and I'm 16 going to vote to support it. 17 Thank you. 18 ACTING PRESIDENT VALESKY: 19 Senator Ranzenhofer to be recorded in the 20 affirmative. 21 Senator Leibell, to explain his 22 vote. 23 SENATOR LEIBELL: Thank you, 24 Mr. President.
Candyco Transcription Service, Inc.
(518) 371-8910 1 This is one of those things that 2 when you go home to your district you hear 3 about everywhere you go. Over the last few 4 weeks and months, every volunteer firefighter 5 I think I met brought this up as a serious 6 issue that would impact on their ability to 7 serve as volunteers in our communities to 8 protect all of our families, frankly, while 9 we're all up here. Or down here, as the case 10 may be. 11 So this is an important piece of 12 legislation. I'm pleased to see that it's 13 been passed in a bipartisan fashion. And I'm 14 optimistic the Governor will sign this 15 quickly. 16 Thank you. 17 ACTING PRESIDENT VALESKY: 18 Senator Leibell to be recorded in the 19 affirmative. 20 The Secretary will announce the 21 results. 22 THE SECRETARY: Ayes, 61. Nays, 23 0. 24 ACTING PRESIDENT VALESKY: The
