What's happening
This bill requires state approval for dairy transporters to impose hauling surcharges on farmers, limiting surcharges to justified transportation cost increases.
Why it matters
Protects farmers from arbitrary or excessive hauling fees. By requiring state approval for surcharges, the bill helps ensure that dairy transporters cannot impose unexpected or unjustified extra costs on individual farmers, co-ops, or associations, which can be particularly important for small or struggling operations.
Links surcharges directly to actual cost increases. Only surcharges that are the result of real, industry-wide cost spikes—such as fuel price surges or other unforeseen expenses—can be approved. This prevents transporters from using surcharges as a way to increase profits at the expense of producers.
Adds state oversight and transparency. By putting surcharge approval in the hands of the Department of Agriculture and Markets, the legislation introduces a layer of accountability, likely leading to more transparent and fair pricing practices within the dairy supply chain.
Could help stabilize milk prices for consumers. By limiting unnecessary cost increases on farmers, the bill may indirectly help keep downstream milk and dairy prices more stable for consumers, since unchecked hauling fees can eventually get passed along the supply chain.

AN ACT to amend the agriculture and markets law, in relation to transportation surcharges
The People of the State of New York, represented in Senate and Assembly, do enact as follows:
Section 1. The agriculture and markets law is amended by adding a new section 257-b to read as follows:
§ 257-b. Transportation surcharges. 1. A dairy transporter shall not require an individual farmer, farming cooperative or a farming association to pay a dairy hauling surcharge; unless such surcharge is approved by the department. The department shall approve transportation surcharges which the commissioner deems justified surcharges.
2. For the purposes of this section, a justified surcharge shall be defined as a charge directly correlated to the actual costs of transportation due to the drastic increase in the cost of fuel and any unanticipated cost that affects the entire dairy industry.
§ 2. This act shall take effect on the sixtieth day after it shall have become a law.
