What's happening

This bill requires the education commissioner to create a method for providing school aid to districts for students with disabilities who transfer during the school year.

Why it matters

  1. Addresses funding gaps for districts enrolling new students with disabilities mid-year. , ensuring schools aren't left without resources to provide required accommodations when students transfer after aid has been allocated.

  2. Creates a dedicated interim aid fund. , meaning districts can access additional money specifically for unanticipated special education costs, reducing financial strain and potential service delays.

  3. Mandates quarterly (rather than annual) apportionment of aid. , so funding can “follow the student” as they move between districts, improving equity and continuity of support for students with disabilities.

  4. May help smaller or rural districts in particular. , since unplanned enrollment of even a single high-needs student can otherwise lead to significant budget shortfalls, impacting not only the new student but others as well.

STATE OF NEW YORK

1886

2017-2018 Regular Sessions

IN ASSEMBLY

January 13, 2017

Introduced by M. of A. CROUCH, FINCH, GIGLIO, OAKS -- read once and referred to the Committee on Education

AN ACT in relation to directing the commissioner of education to establish apportionment methods for certain school districts with respect to students with disabilities

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. Legislative findings. The legislature finds that students with disabilities often need special accommodations in order to achieve the highest standards of learning. These special accommodations are often associated with high costs. The legislature further finds that when a student with a disability transfers to a new school district within the same school year, the new school district is without funding for such student until the beginning of the next school year.

The legislature therefore finds that it is necessary to direct the commissioner of education to establish a method by which a school district may receive necessary aid for students with disabilities at any time, throughout the school year, as may be appropriate.

§ 2. The commissioner of education is hereby directed to establish a method for apportioning school aid for students with disabilities at any time, throughout the school year, as may be appropriate.

§ 3. The commissioner of education shall establish a special fund to be used solely for the purpose of supplying interim aid to school districts that are attended by students with disabilities, where such student or students were not accounted for in the initial apportionment to such school district at the beginning of the school year.

§ 4. The commissioner of education shall apportion monies for students with disabilities on a quarterly basis, and to allow for the apportionment to follow the student from school district to school district throughout the school year.
