What's happening

This bill requires all prospective school employees to undergo a new fingerprint-supported criminal history check, regardless of prior clearances.

Why it matters

  1. Closes a safety loophole by mandating new criminal background checks. even for applicants who previously cleared checks under other school districts, charter schools, or related positions—potentially catching offenses that occurred after their last clearance.

  2. Eliminates exceptions based on prior fingerprinting. , ensuring that all prospective school employees, including bus drivers and those moving between districts or schools, are screened under the same up-to-date process.

  3. May increase administrative burden and costs. for both applicants and school districts, as everyone—regardless of past employment or fingerprint history—must complete a new background check when seeking employment.

  4. Enhances uniformity and consistency in school safety protocols. , reducing the risk that someone with a recent criminal record could be employed in a school due to outdated or transferred clearances.
