HIKIND -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to authorizing school districts to establish rules and regulations to determine academic eligibility requirements for school-sponsored extra-curricular activ- ities The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 1604 of the education law is amended by adding a 2 new subdivision 43 to read as follows: 3 43. To authorize policies establishing rules and regulations, as it 4 deems necessary, that determine academic eligibility requirements as a 5 condition for student participation in school-sponsored extracurricular 6 activities. 7 § 2. Section 1709 of the education law is amended by adding a new 8 subdivision 43 to read as follows: 9 43. To authorize policies establishing rules and regulations that 10 determine academic eligibility requirements as a condition for student 11 participation in school-sponsored extracurricular activities. 12 § 3. Subdivision 4 of section 2503 of the education law is amended by 13 adding a new paragraph e to read as follows: 14 e. Shall authorize the development of policies that set academic 15 eligibility requirements as a condition for student participation in 16 school-sponsored extracurricular activities. 17 § 4. Section 2554 of the education law is amended by adding a new 18 subdivision 28 to read as follows: 19 28. To authorize policies establishing rules and regulations, as it 20 deems necessary, that determine academic eligibility requirements as a 21 condition for student participation in school-sponsored extracurricular 22 activities. A. 7815 2 1 § 5. Section 2590-e of the education law is amended by adding a new 2 subdivision 3-a to read as follows: 3 3-a. promote policies establishing rules and regulations that deter- 4 mine academic eligibility requirements as a condition for student 5 participation in school-sponsored extracurricular activities. 6 § 6. Subdivision 1 of section 2854 of the education law is amended by 7 adding a new paragraph (d-1) to read as follows: 8 (d-1) A charter school shall develop and adopt policies establishing 9 student academic eligibility requirements as a conditions to partic- 10 ipation in school-sponsored extracurricular activities. 11 § 7. This act shall take effect immediately; provided however that the 12 amendments to section 2590-e of the education law made by section five 13 of this act shall survive the expiration and reversion of such section 14 as provided in section 34 of chapter 91 of the laws of 2002, as amended.
