What's happening

This bill grants paid line-of-duty sick leave to public employees with qualifying World Trade Center conditions, with costs reimbursed for smaller municipalities.

Why it matters

  1. Ensures continued financial stability for affected workers. By granting paid sick leave at the employee’s regular rate of pay, the bill helps public employees diagnosed with qualifying World Trade Center conditions avoid loss of income while unable to work due to these illnesses.

  2. Protects accrued sick leave balances. The leave provided under this legislation does not count against an employee’s existing sick leave, preserving their accrued time off for other potential health needs or emergencies.

  3. Retroactive benefits for current sufferers. Employees currently using their own sick leave for qualifying World Trade Center conditions will have their used sick time restored back to the date of diagnosis, offering immediate relief and correcting past financial disadvantages.

  4. Targets support to smaller communities. By reimbursing smaller municipalities and authorities (those serving populations under one million) for the cost of this sick leave, the bill ensures that financial burdens do not deter these entities from supporting affected employees, promoting equitable treatment statewide.

Who cares

  • Public employees with qualifying World Trade Center conditions

Eligible officers and employees who filed a notice of participation in rescue, recovery or cleanup operations would receive line-of-duty sick leave at regular pay without using accrued sick leave, even if they worked for a different employer during those operations.

  • Current employees using sick leave for qualifying conditions

The bill would restore sick leave used for those conditions retroactive to the date of diagnosis.

  • Public authorities and municipal corporations with fewer than one million people

The state would reimburse their costs for line-of-duty sick leave granted under the bill.

  • New York State government

The state would provide the leave to eligible state employees and fund reimbursements to covered public authorities and municipal corporations.
