What's happening

This bill grants paid line-of-duty sick leave to public employees with qualifying World Trade Center conditions and reimburses local governments for related costs.

Why it matters

  1. Ensures financial stability for affected public employees. By providing paid line-of-duty sick leave without requiring employees to use their own accrued sick days, the bill helps maintain income and job security for those who become ill from recognized 9/11-related conditions.

  2. Expands eligibility regardless of current employer. The bill covers employees who participated in World Trade Center rescue, recovery, or cleanup—regardless of whether they were working for their current public employer at the time of exposure—broadening the pool of eligible workers.

  3. Offers retroactive benefits. Employees already diagnosed and using their own sick leave for qualifying conditions will have their used leave restored, meaning they won't be penalized for illnesses that occurred before the law’s passage.

  4. Reduces local fiscal impact. By mandating state reimbursement for local governments and authorities (outside NYC) for the cost of this sick leave, the bill removes financial barriers that might otherwise discourage localities from supporting affected workers.

Justification

Officers and employees of the State, public authorities and municipalities outside New York City risked their well-being when they helped rescue and recover bodies while cleaning up the World Trade Center after tragedy hit New York City. Over the last sixteen years, these brave individuals have faced, and are currently facing, a multitude of health issues that require several doctor visits and time off. Although we cannot cure them of their illnesses, we must recognize their ultimate sacrifice and try our best to help them during these difficult times. This legislation would ensure they have a line of duty sick leave so that they can receive treatment for the illness and convalesce without loss of their accrued sick leave.
