What's happening

This bill legalizes and validates a 2014-2015 transportation contract for the Plainview-Old Bethpage Central School District despite procedural errors.

Why it matters

  1. Ensures the school district receives state transportation aid. By legalizing the contract despite procedural errors, the bill allows the Plainview-Old Bethpage Central School District to receive state funding it might otherwise have lost, supporting its budget and student transportation.

  2. Protects the district from legal or financial penalties. The bill retroactively validates the district’s actions, shielding it from possible lawsuits or the need to repay funds due to technical violations in the contracting process.

  3. Sets a precedent for addressing procedural mistakes. This action signals that the state may be willing to forgive certain administrative errors in school district contracting if the underlying service was properly provided, which could impact how future errors are addressed statewide.

Title of bill

An act relating to legalizing, validating, ratifying and confirming a transportation contract of the Plainview-Old Bethpage Central School District

Purpose

This bill would correct a clerical error between the Plainview-Old Bethpage Central School District and the State Education Department in the 2014-15 school year

Summary of specific provisions

Section 1: Legalizes, validates, ratifies, and confirms a transportation contract of $5,642,308 in connection with a transportation contract of the 2014-15 school year.

Section 2: Directs the Department of Education to consider the aforementioned contract for transportation aid.

Section 3: Sets the effective date

Justification

This bill seeks to mitigate the negative impact to the Plainview-Old Bethpage school district which would lose a major portion of its State aid due to a clerical error on the part of the district, which may result in the loss of transportation aid.

Without the restoration of the transportation aid, the school district would be faced with either cutting the quality and scope of its educational programs or raising real property taxed dramatically. This would place an undue burden on their residents and present hardships to many in their community.
