What's happening

This bill establishes new standards for the installation, monitoring, and maintenance of fire suppression systems at gas stations in New York.

Why it matters

  1. Mandates modern, automatic fire suppression. All gas stations would be required to have automatic fire-extinguishing systems specifically designed for petroleum fires, increasing public safety and reducing the risk of catastrophic incidents.

  2. Requires professional oversight and maintenance. Only trained and knowledgeable technicians can install, alter, or repair these fire suppression systems, and stations must keep detailed inspection records for at least five years. This reduces the likelihood of system failures due to improper handling or neglect.

  3. Imposes strict operational and compliance consequences. If a fire suppression system is discharged or inoperative, fuel dispensers cannot be operated unless specifically approved by the department. Non-compliance could result in losing the building’s certificate of occupancy or the permit to operate, providing a strong incentive for adherence.

  4. Enforces regular system testing and third-party monitoring. Systems at unattended self-service stations must be remotely monitored by an approved supervising station, and all systems must be regularly inspected and tested per manufacturer guidelines, ensuring ongoing reliability and quick response in emergencies.

Who cares

  • Gas station owners and operators

The bill would require fire suppression installation, servicing, testing and recordkeeping, with noncompliance resulting in revocation of the building’s certificate of occupancy and/or the permit to operate fueling dispensers.

  • Unattended self-service gas stations and supervising stations

Automatic fire-extinguishing systems at unattended facilities would have to be monitored by an approved supervising station.

  • Fire suppression system technicians

Installation, alteration, testing, repair and maintenance would have to be performed by technicians trained and knowledgeable in the specific system.

  • State Fire Prevention and Building Code Council

The council would have to take the actions necessary to implement the bill by its effective date, 180 days after becoming law.

Title of bill

An act to amend the executive law, in relation to establishing installation and maintenance standards for gas station fire suppression systems

Purpose or general idea of bill

The purpose of this bill is to promote fire safety at gas stations by ensuring the state uniform fire prevention and building code includes installation and maintenance standards for gas station fire suppression systems.

Summary of specific provisions

Section one of the bill creates standards for gas station fire suppression systems. Such standards include requiring automatic fire extinguishing systems using an extinguishing agent to be suitable for petroleum fires, requires that such systems be monitored if they are at unattended service stations, requires that the dispensing area where liquid motor fuel is dispensed shall be provided with a dry chemical fire extinguishing system that meets certain requirements; and requires that such automatic fire extinguishing systems be serviced regularly.

The bill also provides that failure to comply with these requirements of this section could result in revocation of the building's certificate of occupancy and/or the permit to operate fueling dispensers.

Section two of the bill provides an effective date of 180 days after enactment.

Justification

New York has long led the nation when it comes to enacting commonsense safety regulations for drivers. This notion has also been extended to motorists filling up at their local gas station. This regulation has been on the books in New York for decades, and has protected many New Yorkers from serious harm. We need to ensure that this vital safety measure continues to be the law in New York. Gas station shutoffs fail all the time, and once more, there is always residual fuel in the gas lines of the pump that when sparked can cause a vehicle to catch fire. Without these mandated fire suppression systems, New York motorists are at risk of hazardous injuries.
