What's happening
This bill allows English language learners under 21 in regular day school to join employment preparation programs at no extra district cost.
Why it matters
Expands access to career readiness. By allowing English language learners (ELLs) under 21 in regular day school to join employment preparation programs, the bill gives these students earlier and more direct access to workforce training opportunities, which can be crucial for their future job prospects and integration.
Removes financial barriers for schools. The provision that participation comes at no additional cost to school districts or BOCES means schools can support ELLs’ career development without worrying about budget strains or the need for new funding streams.
Targets equity for immigrant and ELL students. ELLs often face unique challenges in both language acquisition and job readiness. This bill specifically aims to close opportunity gaps by ensuring these students are not excluded from programs that can help them succeed post-graduation.
Excludes from certain funding calculations. By stating that these students won’t be counted under certain existing funding formulas (paragraphs b and h), the bill seeks to avoid unintended financial impacts or double-counting, streamlining participation without complicating school district finances.

Title of bill
An act to amend the education law, in relation to employment preparation education programs
Purpose
To allow English language learning students under the age of twenty-one to participate in approved employment preparation education programs.
Summary of provisions
This bill amends Subdivision 11 of section 3602 of the education law to allow any student under twenty-one years of age who attends regular day school classes and is designated as an English language learner by his or her school district or BOCES program to participate in an approved employment preparation education program, provided that space is available.
Justification
Under current law, English language learning (ELL) students under the age of twenty-one are precluded from participating in approved employment preparation education programs because the age of eligibility for students is twenty-one years and older. As a result, ELL students under the age of twenty-one are unable to participate in these programs even if there is space available for them in the program. Opening these programs up to ELL students under the age twenty-one will help them get the education and training that they desire.
