What's happening

This bill establishes the Town of Yorktown Industrial Development Agency to promote economic development within Yorktown, New York.

Why it matters

  1. Creates a dedicated local agency. empowered to offer incentives and support specifically tailored to Yorktown’s economic development needs, rather than relying on county or regional agencies that may not prioritize the town.

  2. Limits agency’s authority to Yorktown’s boundaries. , ensuring that projects and investments directly benefit local residents and align with the town’s own priorities, rather than being diverted to neighboring areas.

  3. Requires the agency to consider local zoning, planning regulations, and comprehensive land use plans. , which means that any development promoted by the agency must fit within Yorktown’s existing vision and regulations for growth.

  4. Gives the Town of Yorktown’s governing body the power to appoint agency members. , providing local accountability and an opportunity for residents to influence who shapes economic policy in their community.

Title of bill

An act to amend the general municipal law, in relation to establishing the town of Yorktown industrial development agency

Purpose

This legislation recreates the Town of Yorktown Industrial Development Agency and provides for its functions, powers, and duties.

Summary of provisions

Section one amends the General Municipal Law by establishing a new section 925-s that reestablishes the Town of Yorktown Industrial Development Agency.

Justification

Industrial Development Agencies in New York State are created to promote the economic welfare and prosperity of the inhabitants of a municipality or county. Further, it is their function to actively attract and encourage development in a particular area.

Pursuant to General Municipal Law section 856(1)(b)(2), an Industrial Development Agency ceases to exist if at the expiration of ten years, there are no outstanding bonds or other obligations. Since the Town of Yorktown Industrial Development Agency has no outstanding bond as required by statute, they are no longer considered in existence.

Thus, this legislation reestablishes the Industrial Development Agency in the Town of Yorktown, located in Westchester County. Many local employers have requested this legislation in an effort to continue to be able to promote economic and recreational opportunities within the town.
