What's happening
This bill requires liability insurance policies for motor vehicles to also cover agricultural trailers being towed.
Why it matters
Expands liability protection. By requiring insurance policies to cover agricultural trailers when towed, the bill ensures that accidents or damages involving these trailers are financially protected, reducing risk for both farmers and other drivers.
Reduces gaps in coverage. Previously, there may have been ambiguity or lack of coverage for agricultural trailers, potentially leaving trailer owners personally liable for accidents. This amendment closes that loophole, clarifying insurance responsibilities.
Supports agricultural operations. Farmers often rely on trailers for transport. By streamlining insurance requirements and protections, the bill lowers administrative burdens and potential costs related to insuring equipment, supporting the agricultural sector’s operational needs.

Title of bill
An act to amend the vehicle and traffic law, in relation to agricultural trailers being covered under the towing vehicles liability insurance
Purpose
To permit insurance coverage for trailers used for agricultural purposes under the towing vehicles liability insurance.
Summary of provisions
Section 1 amends the Vehicle and Traffic law at section 345 by adding a new paragraph, providing the motor vehicle liability policy shall cover any agricultural trailer, as defined in schedule E of subdivision 7 of section 401, being moved by a motor vehicle covered under such policy.
Section 2 provides an effective date.
Justification
As defined in the Vehicle and Traffic law, an agricultural trailer is a trailer, other than a coach or house trailer or semitrailer, owned by a person who is engaged in agricultural production. The Department of Motor Vehicle considers an agricultural trailer to be commercial; a trailer is commercial if used for activities resulting in direct or indirect compensation, requiring insurance.
This bill extends an individual's motor vehicle liability coverage to include agricultural trailers thereby eliminating the need for individuals to seek separate coverage for their agricultural trailers.
