What's happening
This bill updates the education law to allow for multiple reimbursement methodologies for tuition at approved private schools and special act school districts.
Why it matters
Flexibility for Schools. By allowing for multiple reimbursement methodologies instead of just one, the bill gives approved private schools and special act school districts more flexibility to match their tuition funding to their real costs and unique circumstances.
Potential for Improved Services. Schools that serve students with disabilities or special needs may be able to adopt reimbursement models that better support individualized education plans, leading to potentially higher quality and more tailored services for students.
Impact on Funding and Accountability. Multiple reimbursement approaches could allow the State and schools to pilot or adopt methods that balance cost control with educational quality, possibly affecting how public funds are distributed and monitored.
Collaboration Between Agencies. The bill continues to require consultation between the Department of Education and other state agencies, ensuring that changes to tuition reimbursement methodologies are coordinated and consider broader policy impacts.

Title of bill
An act to amend the education law, in relation to reimbursement method- ologies for tuition
Purpose
This legislation will require the commissioners of education to develop separate reimbursement methodologies for tuition and maintenance of approved private schools and special act school districts.
Summary of provisions
Section 1 of the bill amends education law section 4405 (4) to provide that the commissioner of education shall develop reimbursement methodol- ogies for the tuition and maintenance components of approved private schools and special act school districts.
Section 2 is the effective date.
Justification
"Special Act School Districts" are public school districts created by special action of the legislature for the purpose of providing education and related services to students with disabilities-physical, emotional and/or mental. Approved private schools also provide education and related services to this student population.
Current law requires the commissioners of education to establish one methodology to calculate tuition and maintenance rates for Special Act public schools and private schools. This is significant since public schools, including Special Acts, have additional public school expenses that nonpublic schools do not.
This bill will allow these agencies to develop separate methodologies for tuition and maintenance rates for the Special Act public schools and the nonpublic school districts. This will allow for appropriate public school expenses incurred by Special Act schools to be included in these rates.
