What's happening
This bill extends until July 31, 2019, provisions treating certain town trustees as municipal corporations under section 72-h of general municipal law.
Why it matters
Allows trustees in Southampton, East Hampton, and Southold to continue operating with the same legal powers as municipal corporations under section 72-h of general municipal law,. which can affect how they manage, acquire, and dispose of public lands and property.
Extending this status until 2019 gives these local trustee boards more flexibility and authority in local government affairs,. potentially impacting land use decisions, public access, and conservation efforts in their towns.
The extension may help maintain continuity in local governance and public services,. avoiding disruption that could occur if the special provisions were to expire, which could affect residents, local businesses, and community planning.

Title of bill
An act to amend chapter 387 of the laws of 2013 relating to including the trustees of the Freeholders and Commonalty of the town of Southampton, trustees of the Freeholders and Commonalty of the town of East Hampton and the trustees of Freeholders and Commonalty of the town of Southold as municipal corporations for the purposes of section 72-h of the general municipal law, in relation to extending the expiration of such provisions
Purpose
This bill would extend until July 31, 2019 provisions relating the inclusion of the Trustees of the Freeholders and Commonalty of the Town of Southampton, the Trustees of the Freeholders and Commonalty of the Town of East Hampton and the Trustees of the Freeholders and Commonalty of the town of Southold as municipal corporations for the purposes of section 72-h of the general municipal law.
Summary of provisions
Section 1. Extends the sunset date of Chapter 86 of the Laws of 2015 to July 31, 2019 for the inclusion of the Trustees of the Freeholders and Commonalty of the Town of Southampton, the Trustees of the Freeholders and Commonalty of the Town of East Hampton and the Trustees of the Freeholders and Commonalty of the Town of Southold as municipal corporations for the purposes of section 72-h of the general municipal law.
Section 2. Effective date.
Justification
Typically, the County of Suffolk transfers land pursuant to section 72-h of the general municipal law. This section states that land transfers only occur to municipal corporations, which through definition are limited to county, town and village government. While not a taxing jurisdiction, the Trustees of the Freeholders and Commonalty of the Town of Southampton, the Trustees of the Freeholders and Commonalty of the Town of East Hampton and the Trustees of the Freeholders and Commonalty of the Town of Southold are clearly a form of local elected government and would greatly benefit from the ability to receive land at no cost from the County to be placed under their stewardship. This legislation would provide that for the purposes of section 72-h of the general municipal law, the term "municipal corporation" shall include the Trustees of the Freeholders and Commonalty of the Town of Southampton, the Trustees of the Freeholders and Commonalty of the Town of East Hampton and the Trustees of the Freeholders and Commonalty of the Town of Southold.
