What's happening

This bill requires sperm and ovum storage facilities to inform clients in writing about inheritance rights for posthumously conceived children.

Why it matters

  1. Ensures clients are fully informed. By mandating written notification about inheritance rights for children conceived after a parent’s death, the bill helps clients make legally informed choices about storing reproductive material.

  2. Reduces potential legal disputes. Clear disclosure can help prevent future conflicts or confusion among surviving family members regarding the inheritance rights of posthumously conceived children.

  3. Promotes ethical practices among storage facilities. Facilities must proactively address a significant legal issue, encouraging greater transparency and responsible handling of reproductive materials.

  4. Empowers clients to plan their estates. Clients who are aware of these inheritance laws can better plan their wills or trusts, directly impacting how their assets might be distributed to future children conceived through stored sperm or eggs.
