What's happening

This bill increases fines for illegally parking in handicapped spaces in New York, especially for repeat offenders.

Why it matters

  1. Increasing fines for repeat offenders. The bill doubles the maximum fine for a second offense within two years in the same municipality, raising it from $150 to $200. This is intended to deter repeat violations and signal that enforcement will be stricter for those who continue to disregard handicapped parking rules.

  2. Local discretion preserved. While the bill sets new minimum and maximum fines, it still allows local laws to impose even larger fines, giving municipalities flexibility to address local concerns and potentially enforce even harsher penalties if they choose.

  3. Broadens who can be fined. The bill clarifies that not only those without a permit, but also those misusing a permit (e.g., using someone else’s or not transporting the permitted person) and those parking in the access aisle can be fined, closing loopholes and strengthening enforcement.

  4. Reinforces immediate enforcement options. The law continues to authorize ticketing officers to order the removal and storage of vehicles parked illegally in handicapped spaces or access aisles, ensuring that consequences can be both financial and immediate, which may further discourage violations.
