What's happening

This bill allows New York to require a specific period of residency before someone can receive certain social services.

Why it matters

  1. Could restrict access to social services for recent arrivals. By allowing the state to set a minimum residency period, this amendment could delay or deny benefits like public assistance, housing aid, or other support to people who have not lived in New York for a specified time.

  2. May impact vulnerable populations. Groups such as newly arrived low-income families, domestic violence survivors fleeing from other states, or people experiencing homelessness might face barriers to urgently needed services if they don’t meet the residency requirement.

  3. Shifts discretion to the legislature. The amendment explicitly gives the state legislature the power to set these rules, meaning future laws could further define or change which services require residency and how long someone must have lived in New York to qualify.
