What's happening
This bill clarifies that all persons present in a room with visible controlled substances under certain conditions are presumed to knowingly possess them.
Why it matters
Expands liability for drug possession. By clarifying that everyone present in a room with visible controlled substances (under certain conditions) is presumed to knowingly possess those substances, the bill broadens who can be charged, even if they did not physically possess the drugs.
Raises the stakes for social settings. This presumption could impact people who are merely present at social gatherings or private spaces where drugs are visible, increasing the risk of criminal charges for bystanders or uninvolved individuals.
Narrows exceptions to the presumption. The only way to avoid the presumption is if someone is both authorized to possess the drug and it remains in its original container, or if the drugs are found on one person’s body—making it harder for others in the room to avoid prosecution.
