What's happening
This bill changes how taxes from ride-hailing trips are deposited and distributed, directing more funds to public transportation assistance accounts.
Why it matters
Redirects ride-hailing tax revenues to public transit. The bill changes how taxes from ride-hailing (TNC, or “transportation network company”) trips are deposited and specifically directs those revenues to dedicated public transportation operating assistance accounts, rather than pooling them with general state revenues.
Creates accountability and oversight for transit funding. It gives the State Comptroller, Budget Director, and Transportation Commissioner explicit authority to determine how these funds are allocated, adding layers of oversight and making sure funds are used for their intended public transit purposes.
Protects local transit funding from municipal cuts. The bill allows the state to withhold ride-hailing tax transfers from local transit agencies if a county or municipality reduces its own support for public transportation, discouraging local governments from slashing their own funding and relying solely on new state resources.
Ensures equitable distribution of funds. The legislation mandates that ride-hailing tax revenues be distributed proportionally based on where trips originate, and further divides funds between bus and commuter rail services in areas that have both, aiming for a fair and needs-based allocation to transit systems outside New York City.

Title of bill
An act to amend the tax law and the state finance law, in relation to authorizing funds to be transferred to the public transportation system operating assistance account and the metropolitan mass transportation operating assistance account
Purpose
The purpose of this bill to dedicate TNC revenues generated outside the City of New York to local transit operations.
Summary of provisions
Section 1. amends subdivision 1 of section 171-a of the tax law to provide technical changes.
Section 2. amends subdivision 1 section 171-a of the tax law to provide technical changes.
Section 3. amends sections 1298 of the tax law to provide protections for TNC revenues and dedicate them to local transit purposes.
Section 4. amends Section 88-a of the State Finance Law to direct INC revenues generated outside the Metropolitan Commuter Transportation District (MTCD) to the PTOA fund, which supports Upstate transit purposes. It also authorizes enforcement of maintenance of effort requirements to ensure that these revenues are not offset by reduced State or local assistance.
Section 5. amends Section 88-a of the State Finance Law to dedicate TNC revenues generated within the MTCD, but outside of New York City, to downstate transit purposes outside the City of New York (MMTOA). These funds can be dedicated to commuter rail and local bus services. Mainte- nance of effort authorization is included for the Comptroller to ensure that these revenues are not offset by reduced State or local assistance.
Section 6. is the enacting clause.
Justification
In 2017, New York State granted special authorization for transportation network companies (TNCs) to operate outside of the City of New York. Under current law, a 4% assessment fee is imposed on every TNC prear- ranged trip and is deposited into the General Fund. This legislation redirects those assessment fee revenues back to local transit operating accounts, dedicated to funding local transportation systems. These addi- tional funds will help localities strengthen and improve existing local transit systems like buses, as well as supportitiecommuter rail service in counties like Nassau, Suffolk and Westchester.
Further, this legislation prevents counties or municipalities from effectively diverting TNC funds collected by reducing their annual oper- ating payments to local transit systems.
Fiscal implications
This bill is estimated to dedicate $24 million per year to public trans- portation systems when fully realized. This bill does not impose any new taxes or fees.
Effective date
This act shall take effect on the first of July next succeeding the date on which it shall have become a law.
