What's happening

This bill removes competitive funding for full-day pre-kindergarten programs and ensures sufficient funding for all qualifying programs statewide.

Why it matters

  1. Removes competitive grant process. By eliminating competition for funding, the bill ensures all qualifying pre-kindergarten programs get state support, reducing uncertainty and administrative burden for school districts and providers.

  2. Expands equitable access across regions. The bill mandates that every region outside New York City receives enough funding to serve all eligible children, potentially reducing disparities in early childhood education availability, especially in under-resourced areas.

  3. Shifts program evaluation focus. Without competitive scoring, the emphasis moves from program innovation and proposal-writing skills to simply meeting qualifying criteria, which could standardize quality but may reduce incentives for unique programming.

  4. Potential for greater program stability and planning. Guaranteed funding for qualifying programs allows districts and providers to plan more effectively, hire staff with greater confidence, and serve more families without annual uncertainty about whether their program will continue.

STATE OF NEW YORK

§ 2. Subdivisions 1 and 5 of section 3602-ee of the education law, as added by section 1 of part CC of chapter 56 of the laws of 2014, are amended to read as follows:

The department shall develop a scoring system, which it shall use to evaluate which applications shall be funded [on a competitive basis] based on merit and factors including but not limited to the criteria listed above and student and community need. Title of bill

An act to amend the education law, in relation to the universal full-day pre-kindergarten program; and to repeal subdivision 4 of section 3602-ee of such law relating thereto

Purpose

To enable all school districts in the state to participate in the state- wide universal full-day pre-kindergarten program.

Summary of provisions

Section one repeals subdivision 4 of section 3602-ee.

Section two removes the competitive elements of the program and provides that the subscription for each region of the state other than the New York city region shall be in an amount sufficient to provide slots for all, qualifying programs.

Section three provides the effective date.

Justification

Although New York enacted a statewide universal full-day pre-kindergar- ten program, many districts outside of New York City have not been able to participate since they have to compete with other districts for limited funds.

This legislation would remove the competitive element from the program, so that any district that applies and meets the requirements of the program would receive funding. Many school districts outside of New York City have not started pre-kindergarten programs because they have not been able to receive funding under the current program. In fact, in the 2015-16 school year, 82% of four-year-olds outside of New York City did not have full-day pre-kindergarten. This legislation would ensure that all four-year-olds in the state have access to full-day pre-kindergar- ten.
